Class Action Accuses Credit.com of Illegal Marketing Calls

Credit.com is being accused of using third party businesses to market services, ultimately harassing customers with unwanted calls and voicemails.

Lead plaintiff Sharrel Dickens claims Credit.com is violating the Telephone Consumer Protection Act (TCPA) by giving out contact information to third parties without consent. 

In a complaint filed Monday in Illinois District Court, Dickens says she was shopping for life insurance last year when she filled out an online inquiry form not hosted or run by Credit.com. 

Dickens reports getting solicitation calls about related credit products from Credit.com and its partners by January, despite never disclosing the contact information with those entities. 

After declining each solicitation, Dickens says she asked to not be bothered again, but Credit.com continued, according to the complaint, at least 10 more times afterward. 

The solicitations would come from different numbers each time, the class action alleged, making it difficult to block. 

Dickens argues Credit.com’s entire business model centers on these alleged online referrals and says Credit.com relies on these third parties to make a profit. 

Credit.com creates marketing campaigns leveraging online surveys collecting contact information from customers and using it in telemarketing, according to the class action lawsuit.

Dickens claims Credit.com is liable for unwanted calls placed by these third parties because they “engage in telemarketing efforts on its behalf.” 

“Vendors are essential to the success of its telemarketing campaigns,” the lawsuit stated. 

The primary purpose of the TCPA is to protect consumers from these types of calls and voicemails. “Americans passionately disagree about many things. But they are largely united in their disdain for robocalls,” the class action stated. 

Dickens further claims in the class action lawsuit she was harmed from the invasion of privacy. Not only did the calls waste her time, she alleges, but also decreased her productivity, caused her to lose concentration, and distracted her to a point she may have injured herself, according to the complaint. 

Dickens is seeking to form a class of members who’ve received these types of calls from Credit.com or its partners within the last 4 years.

The class action lawsuit is asking for up to $1,500 for each violation to each class member.
