USAA class action overview: 

  • Who: Plaintiff Gerardo Solana filed a class action lawsuit against the United Services Automobile Association.

A new class action lawsuit claims the United Services Automobile Association (USAA) did not properly protect the personal information of clients, resulting in the recent USAA data breach.

The full USAA database was accessed between Dec. 20, 2022, and May 18, 2023, but clients did not receive notification that their data was compromised until June 26. The breach affected several thousand customers.

Plaintiff Gerardo Solano argues in the lawsuit that USAA should have done more to keep its customers’ information safe.

“Defendant disregarded the rights of plaintiff and the class members by intentionally, willfully, recklessly, or negligently failing to take and implement adequate and reasonable measures to ensure their (personally identifiable information) was safeguarded, failing to take available steps to prevent an unauthorized disclosure of data, and failing to follow applicable, required and appropriate protocols, policies and procedures regarding the encryption of data, even for internal use,” the USAA data breach class action claims.

USAA should have encrypted data, deleted from databases, kept access off internet, class action claims

The company should have encrypted the personal data of clients and deleted personal information that it no longer needed from its databases before the data breach, the class action contends.

USAA also should have prevented that data from being available via the internet or its website, the class action says. Once Social Security numbers are compromised, like they were in the USAA data breach, there is no easy way to resolve the issue or change the number to protect customers from future identity theft issues, the plaintiff contends.

In October, USAA agreed to a now-closed class action lawsuit settlement to resolve claims it failed to include sales tax in total loss payments to Ohio policyholders.

The settlement benefitted Ohio USAA policyholders who submitted a total loss claim to United Services Automobile Association, USAA Casualty Insurance Co., USAA General Indemnity Co. and/or Garrison Property and Casualty Insurance Co.

    Please add me to this as my account and husbands with USAA has had over $10k in fraudulently disputed payments (we made on auto withdrawal as far back as September 2023) to various credit cards, cable, mortgage, auto lenders, etc. reversed, the money put back in our checking account where they had set up and external account named it as me and nicknamed it as HOME. They fraudulently took the money they disputed as it was put back in the account. They even went to online chat and posed as me to dispute transactions and then withdrew the money. I contacted USAA spoke to a fraud rep. He told me I had a complete account takeover and I would hear from the fraud department in 5 days. Well this is now day 8 and I have not hear a single word from them! I have however received calls from all the creditors who were effected by this fraudulent activity and identity theft.

    I am a long-time member of USAA. I’ve had recent suspicious issues that I’ve not experienced in 16 years. I’ve put significant trust and let my guard down trusting this institution as (for me) prior to 2023, they were excellent.

    I seriously want to be included in this lawsuit. On October 6, (3 day holiday weekend) my checking account had 3000, 4000, 5000 ACH transactions. I called USAA early in the morning to report these were not mine…..the answer was since they were ACH transactions they had to pay them and then I had to dispute the charges. They REFUSED to close or freeze my checking account. I called many, many times and could never get past the front line people who FELT MY PAIN and told me it was being investigated by fraud. I can’t explain how much stress this whole experience has caused…..long story short on November 21st I finally was able to talk to a fraud rep. She told me I had a complete account takeover…..I now have identity theft, my checking account is now overdrawn due to a 5000 fraudulent charge which USAA says they investigated and found the charge is valid ( they don’t tell you any details and the person who made the decision refuses to speak to my son). The fraudsters were able to make 25,000 charges to my checking account, added 4 names of individuals to my bill pay for 10,000 payments, wrote fraudulent checks on my account, charged 7500 on my credit card to ticket master to bet on football games in Vegas, and on top of everything else tried to initiate a 10,000 wire transfer from the new account I opened with a local bank.They finally closed my account December 1st advising me is was overdrawn ….so here I am 2 months later USAA has 2400 of my money, I’m (basically accused of trying to fraudulently get money from USAA ) plus I have to deal with all the problems of identity theft because of a problem USAA created, I’m sure my excellent credit will be ruined, and I’m still trying to figure out how a retired employee, with 35 years of insurance,& banking with USAA….. who always paid her bills on time and was never late in any payments got to this point. This is a David vs Goliath story and unfortunately Goliath is winning…….

    My son and I have USAA checking and savings. Just recent, 7 Dec 2023, my son’s account was hacked, and the scammer transferred funds in and out. He called USAA frantically asking for fraud dept. Instead of transferring, the USAA Rep handled the call. He explained that he noticed an unauthorized transfer of $3500. The Rep said they will submit a ticket to Fraud to investigate and will hear back in few days. the very next day, his savings was hacked which he didn’t have any funds in it but $42. He called back and again, the Rep said they will submit a ticket to Fraud to look into. It took 4 days to hear from Fraud dept. The outcome was, they saw multiple access from a mobile device and a computer (they gave the IP address) and said he must have given his 6-digit code out. Really? USAA wouldn’t share where the funds went to. They can see the bank and account #. My son tried explaining that he never logs in through a computer and always uses his app. USAA said he owes them back for the funds. Question, why didn’t USAA quickly put a hold on his account from the initial call? They couldn’t answer. Question, why USAA allowed the transfer if savings account only had $42 in it? They said, because of his good standings, the system allowed it. USAA Fraud dept is joke. They don’t understand how hackers, and dark web works. Fraud dept should refer to youtube and listen to ex-hackers explain it. We need help fighting this. His payroll check deposited on 7 Dec was stolen from checking and he can’t pay rent.
