Mom’s Meals was slapped with a class action lawsuit over allegations that it didn’t do enough to protect its customers from a data breach.
Plaintiff Clyde Burry filed the lawsuit, alleging a Mom’s Meals data breach compromised the personal health information of 1.2 million people.
Mom’s Meals provides prepared meals for home delivery, catering specifically to aging adults. It has varying menus based on customers’ individual health conditions and accepts Medicare, Medicaid and self-pay options.
The data breach began no later than Jan. 16, according to the lawsuit. Mom’s Meals, Burry’s lawsuit claims, still has not provided specific details to clients on what health information was stolen and which malware was used to conduct the theft.
“Plaintiff and class members are, thus, left to speculate as to where their PHI (personal health information) ended up, who has used it, and for what potentially nefarious purposes, and are left to further speculate as to the full impact of the data breach and how exactly defendant intends to enhance its information security systems and monitoring capabilities to prevent further breaches,” the Mom’s Meals data breach class action says.
Mom’s Meals data breach was a violation of HIPAA requirements of protecting health data, lawsuit claims
The Health Insurance Portability and Accountability Act (HIPAA) requires health care providers to keep personal health information private. The Mom’s Meals class action contends that the company is covered under HIPAA and thus failed in its duty to keep the information private.
The company was required under HIPAA to provide notice to each individual involved in the Mom’s Meals data breach within 60 days of discovering the breach, according to the Mom’s Meals class action.
