T-Mobile, Data Breach & Class Action Lawsuit

T-Mobile Data Breach Class Action Lawsuit Overview: 

  • Who: Stephen J.Vash filed a class action lawsuit against T-Mobile on behalf of himself and about 100 million of the company’s customers.
  • Why: Vash alleges T-Mobile failed to properly secure and protect his and other class members’ private information from a recent data breach.
  • Where: The class action lawsuit was filed in a Georgia federal court.

T-Mobile US, Inc. filed a motion requesting arbitration of Plaintiff Stephen J. Vash’s claims in an August class action data breach lawsuit and staying all proceedings pending the plaintiff’s arbitration.

T-Mobile filed the motion because it says Vash agreed to arbitrate his disputes with T-Mobile as part of the terms and conditions in the agreements he signed when opening his account.

“This court should not relieve plaintiff of the contractual obligation to arbitrate that he willingly undertook. Instead, under the FAA, this court’s role is to enforce the parties’ arbitration agreements and move this dispute into arbitration as quickly as possible. T-Mobile’s motion to compel arbitration should therefore be granted,” the motion states.

Vash claims T-Mobile betrayed the trust of himself and other members of the proposed nationwide class by failing to properly secure the sensitive personally identifiable information (PII) they were required to provide upon signing up with the company. 

“T-Mobile disregarded the rights of plaintiff and other members of the proposed class by intentionally, willfully, recklessly or negligently failing to take and implement adequate and reasonable measures to ensure that the PII of plaintiff and other members of the proposed class was safeguarded,” the lawsuit states. 

Class Action Says T-Mobile Failed to Protect Private Customer Information

Vash claims he and other class members were required to provide T-Mobile with personal and private information such as last names, birthdates, physical addresses, phone numbers and Social Security numbers, among other information.

T-Mobile should have anticipated the possibility of a cyber attack and was negligent in allowing the data breach to occur, the class action lawsuit claims. 

The company also failed to “sufficiently monitor, audit and update its cybersecurity procedures and patch maintenance and timely detect the data breach, mitigate harm and notify consumers of the data breach,” according to the lawsuit. 

Vash alleges T-Mobile put him and others at risk of substantial harm or inconvenience by allowing the data breach to occur, including identity theft and fraud. The plaintiff says that those affected by the T-Mobile data breach will also have to spend time and money protecting their information from cybercriminals. 

The plaintiff is seeking actual damages, statutory damages and punitive damages, along with restitution, reimbursement for attorney costs and expenses and declaratory and injunctive relief.

    Yes I was severely affected by data breach, fraud since 11/21, identity theft promised LifeLock by t mobile and never got it. Reported to t mobile bank accounts still affected lost my pharmacy technician job,of which I have a disability, icloud images and accounts hacked since December still have such severe identity theft I can’t get mh unemployment claim filed in January I see lawsuits under my name for different states too

      Yes, me too. T-Mobile really did a number on me- found in 5 different breaches and the dark web. They stole my identity purchased all kinds of stuff with my social and did not pay do my credit is affected. No one can verify my identity so I’m turned down for everything I apply for and sometimes I lost access to my accounts. They opened up new lines if service in my name, I get spam phone calls, mail, emails from scammers all of the time. I’ve spent thousands of dollars in restriction to help solve this crime.
      I claimed $8700 on the settlement and I should get 25k or more for what they have done to me life and my livelihood. Anyone know when we’ll get the money! No one from kroll well answer my emails!!!!! So frustrating. Ugh

      It’s odd that the phone number associated with my SSN and personal details in the dark web dumps is an old TMobile store’s phone number that’s been closed for years. I wonder if the data from that whole storefront was lost after it closed.

      My Social security was breached with T-Mobile. Is there a class action suit I can sign up for? Also I contacted T-Mobile and they told me I would have to go into a store to file a complaint. Sounds weird but I’ll call first. This breach really messed up my credit and I’m pissed!

      I was breeched off their website and got a email from macafee who said that my email was breeched from the T-Mobile website . I called T-Mobile who told me that it was a scam and to disgaurd it I suffered the loss of money paid on devices they wouldn’t give back before I actually found out that it was for real the email I had waited to long they had already had a lot in my name and my kotheras whom opened the lines . We was then on dark web my mom kids and their kids we sufgord from horrible loss of cc and loans and just as I was cleaning credit up. Also I asked them to check and see if anything was put into my name they said no but I received 1900.00 bill in name and def had bill from 4.22 they would do nothing to help except complain I would not let my mother pay the bill nor I. Why would we it was dual sim and we could not get phone calls nor pass the call to FCC FDIC or anyone else they were fake . Hackers continued to answer I have a ton of screen shots of coding and also the spyware and different platforms they used I found going through the phone
