ACTS Retirement Services agreed to a class action lawsuit settlement to resolve claims it failed to protect patient information from a 2022 data breach.
The settlement benefits individuals ACTS Retirement Services identities as being among those affected by a data breach in April 2022, including those who received a notice of the breach in July 2022 and October 2022 informing them their information was potentially compromised.
According to the class action lawsuit, ACTS failed to protect patient and employee information from an April 2022 data breach. The breach allegedly compromised names, Social Security numbers, account numbers, treatment information and other sensitive data.
ACTS Retirement Services is a senior living community operator.
The company hasn’t admitted wrongdoing but agreed to pay an undisclosed sum to resolve the class action lawsuit.
Under the terms of the ACTS Retirement Services settlement, class members can receive up to $350 for documented out-of-pocket expenses such as bank fees, credit expenses, other damages and up to three hours of lost time compensated at a rate of $25 per hour. At least one full hour must have been spent dealing with the data breach for class members to claim lost time.
Class members who experienced documented extraordinary monetary losses, such as damages from fraud or identity theft, can receive higher payments of up to $3,500. The claimant must have made reasonable efforts to avoid or seek reimbursement for the loss, which must have occurred between April 7, 2022, and July 17, 2023.
All class members are eligible for two years of free credit monitoring services through Pango. The Identity Defense Complete services include one-bureau credit monitoring, a monthly credit score, transaction monitoring, inquiry alerts, dark web monitoring and more.
In addition, ACTS Retirement Services has agreed to provide security for residents’ and employees’ personal identifying and health information.
The deadline for exclusion and objection is April 16, 2024.
The final approval hearing for the ACTS Retirement Services settlement is scheduled for July 2, 2024.
In order to receive settlement benefits, class members must submit a valid claim form by May 1, 2024.

For ordinary expenses: Phone bills, gas receipts, postage receipts, bank account statements or other documentation reflecting out-of-pocket expenses, purchases made for credit monitoring or
identity theft insurance or professional fees and services.
For extraordinary loss expenses: Bank or credit card statements, letters from the IRS or other tax authorities, letters from state unemployment agencies or police reports.
