T-Mobile data breach class action lawsuit overview: 

  • Who: Jennifer Baughman filed a class action lawsuit against T-Mobile US Inc. 
  • Why: Baughman claims T-Mobile failed to protect the private data of its customers during a data breach the company announced earlier this month. 
  • Where: The class action lawsuit was filed in California federal court. 

T-Mobile was unable to protect personally identifying information from being exposed during a recent data breach that affected an estimated 37 million of its customers, a new class action lawsuit alleges.

Plaintiff Jennifer Baughman claims T-Mobile failed to “exercise reasonable care” in securing its customers’ personal and sensitive information, including names, contact information and birthdates, among other things. 

Baughman argues the data breach against T-Mobile was “highly foreseeable,” making the company’s alleged security failures leading up the incident “particularly egregious.” 

“Upon information and belief, Plaintiff’s and Class Members’ PII was unencrypted and unredacted PII and was compromised due to Defendant’s negligent and/or careless acts and omissions,” the T-Mobile class action states. 

Baughman wants to represent a nationwide class and California class of individuals who had their personally identifying information compromised in the data breach announced by T-Mobile earlier this month. 

T-Mobile customers impacted by data suffered ‘numerous’ injuries, class action says

T-Mobile customers affected by the data breach suffered “numerous” actual and concrete injuries, including invasion of privacy, financial costs incurred and loss of time and productivity, among other things, the T-Mobile class action alleges. 

Baughman argues affected T-mobile customers are at a continued risk of identity theft and will remain so as long as the company allegedly “fails to undertake appropriate and adequate measures” to protect their private information. 

“Defendant could have prevented this … by properly encrypting or otherwise implementing policies, procedures and computer data security programs that provided the level of protection reasonably necessary,” the T-Mobile class action states. 

Baughman claims T-Mobile is guilty of invasion of privacy, unjust enrichment, negligence and breach of both implied and express contract. 

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, nominal, consequential and punitive damages for herself and all class members. 

Last month, T-Mobile and Experian agreed to pay $16 million to resolve numerous claims lobbied at the companies by state attorneys general in response to their handling of a 2015 data breach.

    I was notified that I am a victim in this data breech Once they had my information they went in, they actually opened app a checking account under my name at Wells Fargo and cause me a lot of stress and financial boss. I’m a mother and i’m part of the middle class This is a big issue for me is causing unneeded stress, and it affects not only me bu. It affects my children as well. Seeing that their mom is always stressed out and worried. And having all her time taken app by trying to fix all this, just not right. It makes me so angry that T-Mobile lock that necessary precautions. And didn’t enforce any type of time put towards this situation. To prevent this from happening, it could have been so easy for them to prevent. But yet they fail to do so. I trusted them and they took advantage of my trust

    I have been notified by a credit monitoring service that my SS#, and all other personal info has been found on the dark web and is being used currently as a direct result of T-mobile breach’s. The report has the names and business locations of the individuals who have opened accounts. Some were employees who work at the store. Can I have a representative email or call me so I can give full details. Credit reports show identity theft from multiple individuals who were employed at the store and elsewhere. The credit bureau has placed fraud alerts on my profile for the time being and advised me to change my email addresses, credit cards, all passwords etc. This is a big undertaking to change my email address that I do business through. I don’t know what direction to go into first because all my info is already on the dark web.
