Parker Hannifin Data Breach Data Security Class Action Overview: 

  • Who: The wife of a former employee of engineering and manufacturing firm Parker Hannifin is suing the company.
  • Why: Plaintiff Joan Migliaccio says Parker Hannifin failed to safeguard personal information it stored on its systems, resulting in a data breach.
  • Where: The case was filed in Ohio federal court.

The wife of a former employee of engineering and manufacturing firm Parker Hannifin is suing the company, saying it failed to safeguard sensitive information it stored on its systems, resulting in a data breach.

Plaintiff Joan Migliaccio filed the class action against Parker Hannifin Corporation May 20 in an Ohio federal court, alleging violations of state and federal consumer protection laws.

Migliaccio says her husband was employed at Parker Hannifin in the early to mid-1980s, and the company recorded and stored her information on the company’s systems when her husband signed up for Parker Hannifin’s employee benefits. 

In maintaining her private information, the company promised to safeguard it, she says.

“Defendant, however, did not take proper care of Plaintiff Migliaccio’s [private information], leading to its exposure as a direct result of Defendant’s inadequate security measure,” according to the class action lawsuit.

In May 2022, Migliaccio says she received a notification letter from the company stating that her name, Social Security number, date of birth, address, driver’s license number, U.S. passport number, financial account information, online account usernames and passwords and health insurance enrollment information were compromised.

Parker Hannifin Class Action Alleges Plaintiffs Not Given Adequate Warning, Protection Following Breach

Migliaccio is suing on behalf of people currently or formerly employed by Parker Hannifin and their dependents whose information was stored on Parker’s computer networks and subsequently accessed during the data breach.

Migliaccio says she was not notified of the data breach until May 2022, which was over a year after the information was first accessed.

She says Parker Hannifin has offered no assurance that all personal data or copies of data have been recovered or destroyed. She added that Parker offered 2 years of credit monitoring, which does not guarantee the security of her private information.

She’s suing for negligence, breach of contract, breach of implied contract, breach of fiduciary duty, unjust enrichment, violations of Ohio consumer protection statutes and declaratory and injunctive relief.

Migliaccio seeks certification of the class action, damages, fees, costs, strengthened data storage policies and a jury trial.

Meanwhile, Capital One will pay $190 million as part of a settlement to resolve claims it jeopardized customer information in a 2019 data breach.

    I’m wondering if I’m able to join in on this lawsuit. My story is almost exactly like hers. With the exception I was with them later 80’s I believe. Why would they even still have my records, why weren’t they destroyed? They kept them in there system and now I fell like I’m being punished. This is so sad.
