PupBox experienced a data breach.

A class action lawsuit against Petco claims that a data breach compromised the information of more than 30,000 users of the company’s PupBox website.

Plaintiff April Fesler says she and other consumers have suffered the loss of value of their confidential information, out-of-pocket expenses, and other losses as a result of the Petco data breach.

According to the class action lawsuit, consumers’ names, addresses, email addresses, PupBox.com passwords, credit card numbers, expiration dates, and CVV codes were compromised in the cyberattack.

The Petco class action lawsuit calls the cyberattack “a known and foreseeable risk,” and as such, the defendants failed to take proper steps to secure their customers’ private information. 

To make matters worse, the defendants also allegedly failed to notify consumers that their information had been accessed by a third-party and which specific information had been obtained.

“Had Defendants properly monitored their property, they would have discovered the intrusion sooner,” the class action lawsuit says.

The cyberattack captured customer information between Feb. 11 and Aug. 9, 2020, the plaintiff says. However, Petco did not notify consumers of the data breach until October.

According to the company’s notification letter sent to consumers involved in the data breach, an unauthorized plugin on the PubBox website allowed customers’ personal information to be captured and shared with a third-party server during that period.

The plaintiff and Class Members have or will experience injury such as “fraudulent charges and damage to their credit,” having to purchase credit monitoring, cancelling cards and having them reissued, changing automatic billing settings, paying late fees or declined-payment fees and others. They also have allegedly suffered identity theft.

PupBox experienced a data breach.Fesler says since the data breach, she has received about 10 to 20 scam calls, “which appeared to be placed with the intent to obtain personal information to commit identity theft by way of a social engineering attack.”

She also claims to have received notices from her bank “indicating fraudulent and unauthorized charges on her accounts.”

The class action lawsuit claims that the data breach has caused the plaintiff to spend quite a bit of time using Experian and TransUnion to monitor her credit; she has also put a freeze on her credit.

In addition, she has filed reports with the Federal Trade Commission (FTC) and “has attempted to implement a recover plan.”

Fesler is seeking to represent a nationwide Class of U.S. residents whose private information was compromised in the cyberattack, as well as a Washington subclass.

The plaintiff demands a jury trial and seeks injunctive relief and awards of actual and statutory damages, equitable relief, restitution, disgorgement, attorneys’ fees, statutory costs, pre- and post-judgment interest and any other relief deemed appropriate by the Court.
