Samsung data breach class action lawsuit overview:

  • Who: Plaintiff Steven Wenzel has filed a class action lawsuit against Samsung Electronics America Inc.
  • Why: Samsung allegedly failed to implement adequate data security measures, leaving private data vulnerable to a data breach that took place in August.
  • Where: The Samsung data breach class action lawsuit was filed in Florida federal court.

Samsung Electronics America Inc.’s failure to implement adequate data security measures led customers’ private information to be compromised in a data breach, a class action lawsuit alleges.

Plaintiff Steven Wenzel alleges Samsung failed to take reasonable steps to implement adequate security measures and protect customers’ personally identifiable information, even in the wake of numerous high-profile data breaches.

Samsung allegedly failed to use firewalls, encryption and other standard data-management practices to protect sensitive data from unauthorized actors.

The information allegedly compromised in the Samsung data breach included names, contact information, birthdates and product registration information. 

The Samsung data breach was reportedly discovered Aug. 4, but the Samsung class action lawsuit says the defendant failed to disclose the data breach until Sept. 2, nearly a month after it was discovered.

Samsung data breach was ‘inevitable result’ of inadequate security measures, class action alleges

Wenzel says the Samsung data breach was the “inevitable result” of Samsung’s “cavalier approach to data security.” Even though significant data breaches were occurring across multiple industries, Samsung allegedly failed to maintain adequate security measures, according to Wenzel.

Further, Samsung itself had reportedly been the victim of another data breach earlier in 2022, making it “even more egregious” that the company failed to boost its data security practices, Wenzel says.

“As a direct and proximate consequence of Defendant’s negligence, a massive amount of customer information was stolen from Defendant,” the Samsung data breach class action lawsuit states.

Thousands of Samsung customers and former employees may have had their personal information compromised in the Samsung data breach, Wenzel claims. As a result, their privacy rights have been violated and they are at an increased risk of fraud and identity theft, according to the Samsung data breach class action lawsuit.

Wenzel notes that identity theft victims have to spend numerous hours to repair the damage to their credit. Therefore, he says “[r]eimbursing a consumer for financial loss due to fraud does not make that individual whole again.”

Wenzel filed the class action lawsuit on behalf of himself and a proposed class of U.S. residents whose personal information was contained in the publicly-accessible database and therefore compromised due to the Samsung data breach.

      Please add me this is the forth big data breach I’ve been in I can’t even get a chime card or PayPal I will never be able to buy a house my credit is so fu****. They have flagged me and now I have no home no job and this ass clowns say sorry for inconvenience.

    I had received a message saying my email was compromised and I may be a part of a data breach. Needless to say I got to looking and yes someone had got my info phone # email and who knows what all else they’ve accessed. I’d like to be in on the class action lawsuit against Samsung for data breach

    I saw the article of a data breach last summer but Samsung had stated that consumers private information wasn’t stolen. However, in august 2022, shortly after Samsung’s announcement, I had my identity stolen and more than 15 loans were attempted to be taken out in my name. This person also added themselves to my phone account multiple times and I had to leave the phone company, get a new phone, and change my phone number because I continued to be harassed by these individuals. It got so bad, they even started finding my contact information through work pretending to be a client interested in my sales services. My SSN and credit bureau accounts are STILL locked up to this day because I’m afraid these people will try to pull out lines of credit in my name again. I emailed someone about this issue last year but never heard anything back. Interesting how there are class action lawsuits against Samsung now….even after they swore up and down that no private information was breached. Needless to say, I’d like to be added to this class action lawsuit!

    I too was contacted by Samsung about my info and breach. For 2 months previous to their notice I had blocked from using passwords to most,if not all my personal accounts. Talked to Verizon multiple times con erning all of this. Had a Facebook account for a short period, where a foreign name had taken over my account and language was also foreign. Could not change settings back. I tried several time deleting accounts and resubmitted with no success. My phone # on some accounts were linked to this individual from Facebook also. I had received calls from North Carolina asking for I guess ? The individual who had stolen my identity. Very frustrating time. Verizon did try to problem solve all these issues. With last representative spending a hour or so trying to resolve these issues to no avail. Finally responding she has never encountered any problems like this before. I am 62 years old with limited tech abilities. The whole time thinking I had done something that messed all this up. After notice and being able to access my private info again, I received a text informing me my credit card had been compromised and has been locked. Knowing there are Scams out there…but then knowing what happened with samsung breach, I thought I should respond. Giving most of credit info including SSN, Credit card info, Birth date, ect. My wife and I believe I was Scammed. Had to contact Social Security, banks to block accounts and redo. Had to purchase life lock protection plan Hopefully to secure our accounts. Samsung form letter for notice was very unconcerned and disappointing. Please add me to the class action.

      Also My email account I had forever was compromised. Could not log onto . Tried setting up new ones which made my accounts more messed up
