Samsung data breach class action lawsuit overview:

  • Who: Plaintiff Steven Wenzel has filed a class action lawsuit against Samsung Electronics America Inc.
  • Why: Samsung allegedly failed to implement adequate data security measures, leaving private data vulnerable to a data breach that took place in August.
  • Where: The Samsung data breach class action lawsuit was filed in Florida federal court.

Samsung Electronics America Inc.’s failure to implement adequate data security measures led customers’ private information to be compromised in a data breach, a class action lawsuit alleges.

Plaintiff Steven Wenzel alleges Samsung failed to take reasonable steps to implement adequate security measures and protect customers’ personally identifiable information, even in the wake of numerous high-profile data breaches.

Samsung allegedly failed to use firewalls, encryption and other standard data-management practices to protect sensitive data from unauthorized actors.

The information allegedly compromised in the Samsung data breach included names, contact information, birthdates and product registration information. 

The Samsung data breach was reportedly discovered Aug. 4, but the Samsung class action lawsuit says the defendant failed to disclose the data breach until Sept. 2, nearly a month after it was discovered.

Samsung data breach was ‘inevitable result’ of inadequate security measures, class action alleges

Wenzel says the Samsung data breach was the “inevitable result” of Samsung’s “cavalier approach to data security.” Even though significant data breaches were occurring across multiple industries, Samsung allegedly failed to maintain adequate security measures, according to Wenzel.

Further, Samsung itself had reportedly been the victim of another data breach earlier in 2022, making it “even more egregious” that the company failed to boost its data security practices, Wenzel says.

“As a direct and proximate consequence of Defendant’s negligence, a massive amount of customer information was stolen from Defendant,” the Samsung data breach class action lawsuit states.

Thousands of Samsung customers and former employees may have had their personal information compromised in the Samsung data breach, Wenzel claims. As a result, their privacy rights have been violated and they are at an increased risk of fraud and identity theft, according to the Samsung data breach class action lawsuit.

Wenzel notes that identity theft victims have to spend numerous hours to repair the damage to their credit. Therefore, he says “[r]eimbursing a consumer for financial loss due to fraud does not make that individual whole again.”

Wenzel filed the class action lawsuit on behalf of himself and a proposed class of U.S. residents whose personal information was contained in the publicly-accessible database and therefore compromised due to the Samsung data breach.

    I was also contacted about the data breach In September saying my information may have been compromised, that they would Provide a credit check or report at no cost I guess. I am pretty upset that they new that their was a breach and said nothing till September. So how do I sign up or be add to the lawsuit for the Negligence on there part.

    I would like to be added I was informed about this during the summer and I got spam calls all day every day. Not to mention my acct was hacked as well

    Add me please, I get spam calls every single day. I have to keep it on silent most of the time because the ringing just doesn’t stop. It seems like a lot of the calls that match my area code and prefix. But I live in between 2 very small towns, my town is actually considered a village, so I have learned when to pick up. I have had days of over 100 spam calls. I have also been taking screen shots (when i remember, if I am trying to block 1 call as 30 more are ringing in). My kids get mad when I have my phone down but I can’t stand the constant ringing. I just last week made sure I am still on the no call registry, but still getting the calls. I have also a few times answered and told the person to stop calling but they don’t and blocking is a joke in most cases because they just call from a different number. PLEASE HELP ME!!!!

    I was notified in early September that my phone was hacked at the end of July. The e-mail stated that I was one of about 3000 customers that were affected. The e-mail stated that there was no action necessary on my part. Shortly thereafter, Samsung kept sending me “updated Terms of Service” to which I never acknowledged and agreed to. I have since terminated my service on the Samsung phone and purchased different brand of phone. I am not sure if the aforementioned Class Action is part of this breach, or a new Class Action needs to be started. If it is, please include me.

      Include me also please I started getting all types of spam all of a sudden out of nowhere on my Samsung Galaxy phone & it didn’t stop next thing I knew I heard about the Samsung data breach now it makes sense so I changed my type of phone.

        Received an email stating my account was breached in July since then my phone has been hacked, my financial accounts as well. In the past month I’ve had to get all new credit and debit cards.

          I also had to hot-card my main card I use because on Oct 12th I was hit with 1 Comcast charge for $290.33 and another Comcast charge of $297.33… 1 charge of $180 for AT&T and a 2nd for $219. All for on the same day. All before my bank questioned it so they said there was a charge for Lowes also, I didn’t ask the amount for that I cut up my card right then. I called to talk to these companies myself as my bank said they can refund it back faster then they can take it off my bill. AT&T says they cannot help me since I didn’t know the card number, and cvc code. I informed them i had already destroyed the card and she says she cannot help me and transferred me to a supposed fraud agent who I got an answering machine that didn’t allow for messages….so I have called every number I could find with them. Comcast says they will refund it but that it will take 3-5 business days. I have been fighting with these people since the 12th. I don’t know if I received an email or not because just like my phone, pam has eaten up my email. There should be a class action over spam all together. It gets in the way slowing everything down, not even just slowing pc’s down but all the time it takes us people to find what we need. If I am expecting an email I pretty much use the search email slot, because there is just sooo much. And even just the time that we have to search for crap like this because we don’t know what else to do. Nobody is stopping spammers. It went from a lil bit of spam snail mail to, over flooded emails, now boom into the phones waves. I dread even getting on my home computer just as much as my phone, spam is everywhere. I have been trying to purchase airfare, but thanks to my credit card problems the airfare is growing higher everyday, while I am waiting to have the money put back on my card. Spam needs to be outlawed!

            I understand you 100 percent! I have had to change my phone number 4 times with 4 different carriers, 3 actual devices, any/all email accounts, log-in information including passwords, banks that I did not sign up for, SSDI, UNEMPLOYMENT… I could go on and on…

          I should have added, that even though I stated to the companies that we couldn’t even get their services (Comcast & AT&T both). Both companies seemed shocked when they looked it up and said “Oh we don’t have services in the area”. Um yea thats what I was trying to tell them. Both companies stated they were putting me through to someone else and of course couldn’t get anyone to answer in their fraud departments. I will see what happens tomorrow. I don’t remember which 1 of the 2 companies was asking me what region I was in, and put me on hold for 10 minutes when I was like Idk, and told her where i am located.
