T-Mobile Data Breach Class Action Lawsuits Overview: 

  • Who: Tiffany Bensen filed a class action lawsuit against T-Mobile USA, Inc. 
  • Why: Bensen claims T-Mobile is responsible for an August data breach which exposed the private information of millions of its customers. 
  • Where: The class action lawsuit was filed in New York federal court. 

Another class action lawsuit has been lobbied against T-Mobile over an August data breach which exposed the private information of millions of its customers. 

Plaintiff Tiffany Bensen claims T-Mobile was responsible for the data breach because it failed to implement reasonable safeguards to protect consumers’ private information.

More than 30 class action lawsuits have been filed against the company in response to the data breach, according to T-Mobile, which implored a federal judge in California last month to stay an individual complaint in the face of possible multidistrict litigation. 

Bensen, meanwhile, wants to represent a nationwide Class of consumers as well as a subclass of consumers from all 50 US states who had their private information compromised during the August data breach. 

Bensen echoed the claims of other class action lawsuits filed against T-Mobile in arguing that the company had “inadequate security measures,” which allowed hackers to gain access to its servers and retain customers’ private data. 

“(T-Mobile) negligently failed to take the necessary precautions required to safeguard and protect the (personal identifying information) of plaintiff and the other Class Members from unauthorized disclosure,” the class action lawsuit states. 

T-Mobile Data Breach Put Customers at ‘Imminent Risk’ of Identity Theft, Class Action Lawsuits Allege

The data breach also put T-Mobile customers at a heightened and imminent risk of becoming the victims of identity theft, Bensen said, arguing that the loss of privacy, value of personal information, and necessary mitigation expenses will cause ongoing injury. 

Bensen’s personal identifying information including her name, date of birth, social security number, and driver’s license number were all compromised in the data breach, the class action lawsuit alleges. 

“If Ms. Bensen had known that the defendant would not adequately protect her PII, she would not have allowed Defendant access to this sensitive and private information,” the class action lawsuit states. 

Scams targeting T-Mobile customers have already begun to surface, including one where customers were sent a text purported to be from T-Mobile asking them to take a survey rating the company. 

The texts were actually from an unaffiliated marketing website, raising the question of how it got customers’ information and if the data breach was possibly to blame, according to The T-Mo Report

Bensen filed 54 causes of action against T-Mobile in her class action lawsuit, encompassing all 50 US states, and including consumer protection, consumer fraud, and deceptive trade and business practices act violations. 

Bensen is demanding a jury trial and requesting appropriate injunctive relief and/or declaratory relief as well as compensatory and general damages for herself and all Class Members.

    Add me in I also received an email saying that my data may have been breached once I contact them they said they have fixed the problem and there is nothing to worry about but I see that I still have worry to worry about. I am still with T-Mobile and to see this problem is still continuing is very scary so what will have to be done from here? Please add me to this claim.

      Same here all data sold All my info I went in T-Mobile multiple times since aug til feb telling them even my phone was having issues with internet calls not ringing text and getting 2 factors I’ve had bank acct shut down fraud etc nothing was ever told to me and still unfair to have people using my name try to look up certain info and your own internet blocks it like one person using my information I found through Norton antivirus McCafee did not warn us before hand either I’ve changed numbers phones and still getting compromised

    added myself payupsuckers i broke a phone that was just to dang strange behaving.i still have the photo and box of that phone t-mobile used against us to ruin or opportunities.

      I received an email about the data breach and received 1 year Equifax monitoring service. Up until just recently nothing had been affecting me. I paid my taxes in April 2022 and the i.r.s stated I was due a refund but I needed to verify my identity. I sent all documents but I was denied my refund because they stated my identity still couldn’t be verified even after I sent them my birth certificate, driver’s license and a copy of my social security card. I was denied unemployment. It was the post office fault. I later found out I was denied unemployment because EDD couldn’t verify my identity. EDD supposedly mailed me a document to verify my identity that I never received. I did however received a letter later from edd denying my claim due noncompliance to mail in self identifying documents that the post office never dropped off in my post mailbox. Having Equifax didn’t or doesn’t work. It’s obvious to me now my identity was stolen in the T-Mobile breach and it is being used. I have lost out on money, security and feeling unsafe because of T-mobile.
