T-Mobile Data Breach Class Action Lawsuit Overview: 

  • Who: Ania Villalon, Stephanie Peralta, Brian Grady, and Michael Jones filed a class action lawsuit against T-Mobile USA, Inc. 
  • Why: Plaintiffs allege T-Mobile was negligent in allowing the data breach to occur and put them at risk of identity theft and long-term injury by letting their personal information be exposed.
  • Where: The class action lawsuits were filed in Washington and Oklahoma federal courts.

A pair of class action lawsuits has been lodged against T-Mobile in regard to an alleged data breach earlier this month that potentially exposed the personal information of more than 100 million consumers, which could lead to an increase in identity theft.

The class action lawsuits come on the heels of another class action lawsuit filed in Georgia federal court alleging T-Mobile failed to properly secure and protect the private information of its customers

The company confirmed it had suffered a data breach earlier this month, but not that customer’s private information had been leaked. 

The plaintiffs in both class action lawsuits claim the data breach has exposed them to present injury and risk of future identity theft. One lead plaintiff, Ania Villalon, filed her class action lawsuit in a Washington federal court and wants to represent a nationwide and New York Class of consumers. 

The lead plaintiffs in the second class action lawsuit, which hope to represent a nationwide and Oklahoma Class of consumers, include Stephanie Peralta, Brain Grady, and Michael Jones.

Identity Theft Main Concern Among Plaintiffs in T-Mobile Lawsuit

T-Mobile customers are required to provide personal information to the company including names, addresses, social security numbers, birth dates, and drivers license information. The plaintiffs main concern regarding the T-Mobile data breach is identity theft, according to the class action lawsuits.

“If left unprotected, identity thieves can gain access to and use this highly sensitive information to fraudulently open new accounts, access existing accounts, perpetrate identity fraud or impersonate victims in a myriad of schemes, all of which can cause grievous financial harm, negatively affect the victim’s credit scores for years, and cause victims to spend countless hours mitigating damage,” the class action lawsuit filed in Oklahoma states. 

The T-Moble data breach lawsuit claims that “as a result of Defendant’s actions and inactions,” the plaintiffs and Class Members must “now and in the future closely monitor their financial accounts and information to guard against identity theft.”

Both class action lawsuits allege T-Mobile was negligent and failed in its obligation to protect its customer’s personal information. 

Villalon alleges T-Mobile committed breach of implied contract and violated the Washington State Consumer Protection Act and New York General Business Law

Plaintiffs in Oklahoma allege T-Mobile committed breach of implied contract, breach of confidence, invasion of privacy, breach of fiduciary duty, breach of the Covenant of Good Faith and Fair Dealing, and violated the Oklahoma Consumer Protection Act and the Oklahoma Deceptive Trade Practices Act.

All plaintiffs are seeking injunctive relief and damages for themselves and all Class Members.

    What’s going on with this class action class action lawsuit. It’s 2023 and I never received an email or a check in the mail. But I did receive a letter in the mail stating that my information was exposed by T-Mobile now What do I do!!
    Does anyone know anything thank you

    I have been going through absolute hell since I was part of this data breach. No kidding, each and every day since then, maybe earlier than I was notified, I have spent ALL DAY AND NIGHT, trying to get the hackers off my phone and google account. No matter what I did, they’d be right back in my account, and it’s still happening to this very day. I bought 6 phones in the last year alone trying to get rid of them with no luck whatsoever. Please help me recover some of my sanity from this situation!!!! I’d also like to add that not one time in over 2 years has my bill been correct!!! Not once!!! So I’ve had to be on the phone with T-Mobile each and every month for more than 2 years. I have been over billed multiple times even though I complained , I am still owed hundreds of dollars that I was over billed. Help me!!! I know I’m not the only person who has had this problem. I can’t imagine how much it would have cost me if I didn’t keep up with the bill each month. That’s why they want you on auto pay. Another reason why I shouldn’t have to be charged extra every month for opting out of auto pay. Their bills are never ever correct, so why would I have it automatically deducted!!?????!!
