Real Estate Co Timios Data Breach Class Action Lawsuit Overview:

  • Why: The plaintiffs take issue with a breach of Timios’ online network and its delayed response to the breach.
  • Who: Three Timios customers are suing the real estate company, which offers title and escrow services.
  • Where: The class action lawsuit is pending in California federal court.

Timios Inc., a real estate services company, is facing a class action lawsuit after its online network was breached earlier this year, exposing customers’ personally identifiable information (PII). 

The data breach in question occurred from July 19 and 25 of this year, exposing customers’ names, Social Security Numbers, driver’s license and passport numbers, payment card numbers, and dates of birth. Timios learned of the breach around July 30, 2021, and began notifying affected customers on Oct. 8, 2021, “further exacerbating the harm” to customers, according to the class action lawsuit. 

The lead plaintiffs are a Mississippi resident, Lauren Waters, and two Pennsylvania residents, Jeff Harrington and David Thompson. Each plaintiff was informed their PII had been exposed in a letter from Timios on Oct. 8, 2021. 

Waters, Harrington, and Thompson seek to represent a nationwide class that includes folks whose personal data was compromised by Timios’ data breach from July 19-25, 2021.

Timios Failed To Protect Sensitive Real Estate Data, Complaint Says

The class action lawsuit accuses Timios of negligence, breach of implied contract, and unjust enrichment.

Given the nature of its business, which involves obtaining, using, and profiting off of customers’ PII, Timios had a legal duty to protect that information from unauthorized entities, the complaint says. The plaintiffs argue that they and Class Members “reasonably expected and relied” on Timios’ promise tol “maintain commercially reasonable technical, organizational, and physical safeguards, consistent with applicable law, to protect your personal information.”

In response to the breach, Timios’ letters acknowledged the “imminent risk of identity theft” due to the breach and warned customers to “remain vigilant,” as well as offering a free one-year membership to identity protection services. 

The class action lawsuit requests declaratory, injunctive, and other equitable relief; restitution; compensatory, consequential, and general damages; statutory damages; litigation expenses; and pre- and post-judgment interest.

Recently, a California federal judge has preliminarily approved grocery giant Kroger’s $5 million settlement with consumers over a breach of its software vendor Accellion’s systems that exposed the personal information of over 3.82 million Kroger customers.
