Lawsuit Says Stryker Hip Problems May Require Surgery
By John Curran
Plaintiff John Shewairy alleges in a new lawsuit that the failure of his Stryker Rejuvenate hip implant has led to metallosis side effects and the potential for future surgeries. The Stryker hip lawsuit was transferred from state court to U.S. District Court for the Eastern District of Tennessee on August 8.
Shewairy says Stryker advertised the Rejuvenate hip implant as safe because of a special coating on a titanium alloy stem that when combined with a cobalt chrome neck led to “laboratory testing [that] demonstrates the compatibility of these materials without concern for fretting and corrosion.” However, the Shewairy’s hip replacement lawyer argues that the coating did not in fact prevent metal shavings – a design defect associated with metal on metal hip implants that had been known to medical researchers since the 1980s.
Moreover, the Stryker hip lawsuit alleges that the Rejuvenate was substantially similar to an older product that necessitated a recall in 2009. As evidence, Shewairy’s lawsuit notes that the Stryker Rejuvenate recall occurred in July 2012 — six months after John Shewairy received the implant in January of that year. Blood serum levels of cobalt and chromium remain significant in Shewairy, according to his hip implant lawyer, and he may need a revision procedure.
Numerous product liability lawsuits have alleged that Stryker used an abbreviated approval process where they did not have to submit detailed clinical data for each new device that came on the market with the proprietary titanium alloy and coating. Had they done so, Shewairy and others argue, Stryker hip replacement complications would have been noted and warnings likely issued.
The Stryker hip lawsuit is John Shewairy v. Stryker Orthopaedics, Case No. 13-cv-00478, U.S. District Court, Eastern District of Tennessee. Counts against the medical device manufacturer include state product liability violations for failure to warn and defective design, as well as negligence and breach of express and implied warranties.
