A married couple along with another woman filed a lawsuit against Carnival Cruise Line in federal court after allegedly suffering injuries related to a well-publicized Carnival cruise ship accident that happened that happened aboard the vessel Sunshine near the end of October last year.
According to USA Today, the Carnival cruise ship accident lasted only about a minute and was blamed on a problem originating from the ship’s electrical switchboard.
A cruise line spokesperson told USA Today that the listing to one side which occurred for this minute didn’t stem from unsafe operation of the vessel. This person indicated that shipboard officers quickly appraised and reacted, correcting the listing and preventing the Carnival cruise ship accident from developing into a more serious situation.
The litigants in the Carnival cruise ship accident lawsuit, however, do not minimize the physical or psychological impact of the tilting event. According to Fox News, Susan and Charles O. of Georgia and Alveta J. of North Carolina were all hurt as they were enjoying a meal in the ship’s restaurant.
Fox News reported that Susan sustained an injury to her back while her husband damaged the tendons in his wrist while attempting to alleviate his wife’s tumble. Alveta also claims that she hurt her wrist while trying to break a fall caused by the listing.
Fox News referred to the ship’s tilt in the Carnival cruise ship accident—however short-lived—as causing “Titanic-like” mayhem in that passengers reported panic and chaos among the vacationers.
Although it is unclear whether the ship was filled to capacity, it was capable of housing 2,642 people. The onboard witnesses said that furniture was sliding, and dishes including glassware were falling and breaking around them.
The electrical switchboard problem purportedly interfered with the performance of the fin’s stabilizer which caused the ship tilt to occur. According to an NBC Affiliate in Ohio, counsel for the plaintiffs has indicated that they will pursue a minimum of $75,000 in a compensatory award from the cruise line for the Carnival cruise ship accident.
The attorneys are claiming negligence on the part of the company that allowed the technical issue to go undetected prior to boarding. The attorneys are hoping that Carnival will adjust their procedures to prevent such an event from happening at sea in the future.
The ship sailed out of Cape Canaveral, Fla. on Oct. 28, 2018. The tilting incident occurred not long after departing to sea. While news coverage indicates the ship didn’t return to this port for several days, it is unclear as to whether the opportunity was given to distressed or injured passengers to depart the vessel at another Florida port prior to continuing the cruise.
