The day after Christmas this year, a lawsuit was filed in Connecticut court over a January 2017 big rig accident.
The plaintiff, Jose C., lodged the lawsuit against the driver of a Volvo tractor trailer that was the property of Eastern Freight Ways Inc.
The driver of the tractor trailer and employee of the logistics company was allegedly Guillermo O. Both the company and driver are named defendants.
According to the plaintiff’s account of the big rig accident, the logistics company driver was trying to turn into the entrance of a business called Stock N Lock located at 1094 Windham Road in Windham, Conn. on Jan. 10, 2017.
Simultaneously, Jose was traveling Route 32 southbound—also known as Windham Road–in his Chevy. Jose says he was adjacent to the entrance to Stock N Lock when Guillermo O. backed into the southbound lane without warning causing a collision with the two vehicles.
Jose’s lawsuit alleges that big rig driver Guillermo O. was responsible for the action and by default his employer, Eastern Freight Ways Inc.
Allegedly, Guillermo drove at a speed unwarranted for the conditions presented and did not properly pay attention or look out for other drivers—an act of negligence which resulted in the big rig accident.
Additionally, Jose states in his case that Guillermo failed to warn of his intention to back up with a horn or any sound. Guillermo or his employer purportedly failed to maintain the tractor trailer’s brake system to an acceptable level or didn’t apply the brakes adequately or in enough time to avoid the big rig accident between the Volvo and the Chevy alleges the lawsuit.
Big Rig Accident Causes Big Injuries
As would be expected in a collision between a modest size passenger vehicle and a larger semi-truck, Jose says he was thrown about his automobile due to the physics of the collision.
He suffered grave injuries to his right ankle with three fractures noted on an X-ray, along with bone displacement. Soft tissue injuries to the tendons and ligaments of this area were also found to be present and significant, according to the lawsuit.
In addition to the significant foot injury, Jose claims facial lacerations, gross financial encumbrance due to seeking medical care, and loss of income and earning ability during his recovery period. Currently, he says he is unable to pursue his former career due to the injuries caused by the big rig accident.
Jose is seeking damages to cover his medical expenses and lost work, both now and into the future.
The Eastern Freight Ways Lawsuit is Case No. 3:18-cv-02128-WWE in the Superior Court of the State of Connecticut at New London.
