After a serious 18 wheeler truck crash killed a man in West Virginia, a wrongful death lawsuit has been filed against the truck driver and the trucking company he worked for.

The 18 wheeler truck accident allegedly occurred on Aug. 23, 2017. Plaintiff Annamarie F. alleges the deceased, Russell S., had been driving a car southbound on I-77. The defendant, William W., was also driving his tractor-trailer southbound on the interstate, and he allegedly lost control of his truck, hitting the guardrail and sending his tractor and one trailer off the roadway.

Annamarie says the second trailer turned over and blocked the southbound lanes of the interstate, leading to Russell’s emergency collision with the trailer blocking the road. Another car also approaching the overturned trailer allegedly attempted to avoid the collision but ended up also hitting Russell’s vehicle.

This severe 18 wheeler truck accident allegedly led to Russell’s hospitalization and, three days later, his death on Aug. 26, 2017.

According to the 18 wheeler truck accident lawsuit, the truck driver, William, and the trucking company he was driving for, XPO Logistics, were aware of faulty equipment that meant the truck was “not in compliance with applicable regulations, and should not have been in operation on the day of the collision.”

The wrongful death lawsuit was filed on Dec. 26, 2018, in the U.S. District Court for the Southern District of West Virginia. The lawsuit was filed on multiple counts, including negligence on the part of both the truck driver and the trucking company, as well as punitive damages.
