$1.75M American Vision Partners data breach class action settlement

American Vision Partners agreed to a $1.75 million class action settlement to resolve claims it failed to prevent a 2023 data breach that compromised sensitive patient information.

The American Vision Partners settlement benefits individuals whose Social Security numbers and other personal information were compromised in the November 2023 American Vision Partners data breach.

American Vision Partners is an eye care company with locations in Arizona, Nevada and New Mexico. The company offers LASIK, cataract surgery, cornea surgery and other eye-related services.

In November 2023, American Vision Partners announced it was the victim of a data breach that compromised sensitive patient information. According to the breach announcement, an unauthorized third party gained access to the company’s computer network and the information of 1.6 million individuals.

Plaintiffs in a class action lawsuit against American Vision Partners claim the company could have prevented the data breach through reasonable cybersecurity measures. The plaintiffs argued that American Vision Partners failed to implement such measures, leading to the breach.

American Vision Partners has not admitted any wrongdoing but agreed to a $1.75 million class action settlement to resolve these allegations.

Under the terms of the American Vision Partners settlement, class members can receive either a pro rata cash payment or reimbursement for out-of-pocket expenses.

Class members who experienced losses as a result of the American Vision Partners data breach can receive up to $3,000 for documented expenses, such as fraud or identity theft losses, professional fees, credit expenses, communication charges and other losses.

Class members who did not experience out-of-pocket losses can still submit a claim for a pro rata share of the net settlement fund. Payments will vary depending on the number of claims filed and the amount of the settlement fund after deductions for costs, fees and other expenses.

The deadline for exclusion and objection is Oct. 13, 2026.

The final approval hearing for the American Vision Partners settlement is scheduled for Dec. 14, 2026.

To receive settlement benefits, class members must submit a valid claim form by Nov. 12, 2026.

Who’s Eligible

The American Vision Partners settlement benefits approximately 258,070 U.S. residents whose Social Security numbers and other personal information were compromised in the November 2023 American Vision Partners data breach.

Potential Award

Up to $3,000 in documented loss or a pro rata cash payment

Proof of Purchase

Documentation of out-of-pocket losses reasonably and fairly traceable to the data breach, such as receipts or other documentation that is not self-prepared by the claimant
