A class action lawsuit claims that DirecTV pulls individuals’ credit reports without their knowledge or consent.

The DirecTV class action lawsuit was filed by Toni Nash who says she does not have a business relationship with DirecTV, but DirecTV pulled her credit report, which ended up lowering her credit score.

Allegedly, Nash called DirecTV to ask why the company pulled her credit. She says that her call was not answered, but on Oct. 8, 2018, she got a letter from DirecTV “implicitly acknowledging that it did not have a permissible purpose for pulling her credit report.”

In this letter, the company reportedly agreed to request that credit bureaus remove this inquiry from her report. However, Nash claims that this has not happened, and her ability to obtain credit has suffered as a result.

Nash says that with her credit score decreased, it has been difficult for her to get more credit. Nash claims that DirecTV has similarly pulled other individuals’ credit reports without their consent, and in so doing, lowered their scores.

The DirecTV class action lawsuit says that DirecTV routinely violates the Fair Credit Reporting Act by pulling the credit reports of people who did not give authorization. The plaintiff goes on to say that the FCRA prohibits businesses from pulling credit reports unless there is a “permissible purpose for doing so.”

The DirecTV unlawful credit pull class action lawsuit says that customers like Nash were caused injury by DirecTV’s decision to pull credit, because each credit pull can lower a person’s credit score by up to five points. This allegedly affects a customer financially because this decreases their ability to obtain credit elsewhere, which can cause injury to a customer’s financial health overall.

According to Nash’s credit pull class action lawsuit, DirecTV knew or should have known the requirements of the FCRA but violated the law nonetheless.
