The representative of a deceased Florida man’s estate has filed a Xarelto irreversible bleeding lawsuit as part of a federal multidistrict litigation.
Plaintiff Linda H. is bringing this claim as the personal representative of the estate of the late Gregory H. Linda alleges Gregory suffered injuries including a life-threatening irreversible bleed that was caused by Xarelto.
Linda says Gregory was prescribed Xarelto in August 2014. Soon thereafter, he developed an epistaxis and “suffered a life-threatening, irreversible bleed from the use of Xarelto, as well as severe pain and suffering.”
His injuries led to additional medical expenses and loss of earnings, in addition to non-economic harm like physical pain and mental anguish, Linda alleges.
Her Xarelto irreversible bleeding lawsuit names as defendants Janssen Pharmaceuticals, its parent company Johnson & Johnson, Bayer Healthcare Pharmaceuticals and their related companies. These defendants all are allegedly involved in the development, manufacture and sale of Xarelto, she claims.
Xarelto is an anticoagulant medication. Originally approved for sale by the FDA in 2011, Xarelto is now approved as a treatment and preventative for certain blood clot-related conditions such as pulmonary embolism and deep venous thrombosis.
It’s frequently prescribed for prevention of stroke in patients with atrial fibrillation.
Linda alleges the defendants have negligently failed to warn the public that Xarelto puts patients at risk for dangerous bleeding injuries.
She says that despite their knowledge of this risk, the defendants negligently or fraudulently represented to the public, the medical community and the FDA that Xarelto was safe and effective for its indicated use.
Gregory and his physicians relied on these representations when they chose Xarelto, Linda says. She accuses the defendants of concealing what they knew about the risks associated with Xarelto.
This Xarelto irreversible bleeding lawsuit raises claims including negligence, strict products liability, breaches of express and implied warranties, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation, fraud and deceit and violation of Florida consumer protection laws.
Linda seeks an award of compensatory damages to cover economic and non-economic damages, and an award of punitive damages to deter similar future conduct by the defendants. She also seeks reimbursement of her attorneys’ fees and costs incurred in bringing this litigation.
Xarelto Irreversible Bleeding Lawsuit Joins Others in MDL
Linda’s Xarelto irreversible bleeding lawsuit is part of the Xarelto multidistrict litigation, or MDL, going on in the U.S. District Court for the Eastern District of Louisiana. This MDL is a consolidation of over 2,800 similar claims against Janssen, J&J and Bayer over bleeding injuries attributed to Xarelto.
The first trials in this MDL have been scheduled to begin in February and March 2017. Two more trials will be conducted in a Texas court the next April and May.
A similar consolidation of lawsuits in the Pennsylvania state court system has been organized in the Philadelphia Court of Common Pleas, encompassing about 550 Xarelto lawsuits.
Generally, the plaintiffs in these actions allege Xarelto exposes patients to an excessive risk of bleeding injuries. They accuse Janssen, J&J and Bayer of negligently failing to warn patients and doctors about the risks associated with Xarelto.
