A new class action lawsuit alleges Volvo failed to disclose a defect in certain plug-in hybrid vehicles that causes a fire risk.
Plaintiff Burhaan Saleh claims Volvo knew about the alleged defect but failed to disclose it to consumers. He points to a recall issued by Volvo in March 2025, which affects nearly 73,000 vehicles.
Saleh argues the defect, which affects vehicles manufactured between 2020 and 2022, can cause the high-voltage battery to short-circuit when fully charged and parked.
“Plaintiff was never informed that the high–voltage battery may experience a short circuit within the battery module when the battery is fully charged, and the vehicle is parked,” the Volvo hybrid vehicle fire risk class action says.
Saleh’s wants to represent a nationwide class and Pennsylvania subclass of consumers who purchased or leased certain recalled model year 2020-2021 Volvo S90, 2020-2022 S60, V60, XC60, XC90 or 2022 V90 plug-in hybrid vehicles.
Volvo defect leaves consumers with unsafe, devalued vehicles, class action says
Saleh claims he purchased a 2020 Volvo XC60 based on the company’s reputation for safety and reliability and was never informed of any recalls or defects related to the battery.
As a result, Saleh argues he has been left with a devalued vehicle that poses a fire risk.
“Even if one was to presume that the Recall was effective and offered a true fix, which is by no means a fair presumption, Plaintiff is still burdened with a vehicle that has been devalued by Defendants’ actions,” the Volvo hybrid class action lawsuit claims.
Saleh alleges Volvo is guilty of breach of implied warranty of merchantability, unjust enrichment and strict liability, and of violating the Magnuson-Moss Warranty Act and the Pennsylvania Unfair Trade Practice and Consumer Protection Law.
The plaintiff demands a jury trial and requests declaratory relief and an award of actual, general, special, incidental, statutory and consequential damages for himself and all class members.
Volvo issued a recall late last year for more than 126,000 trucks equipped with Bendix EC80 Advanced Electronic Control Units over concerns the electronic control units could stop working, increasing the risk of an accident.
