Top 10 class action settlement payouts of 2020

Top Class Actions readers have been benefiting from class action settlements all year long!

While many class action settlements provide relatively small payouts, some provide a few hundred dollars.

And then there are the settlements that exceed expectations, reaching into the thousands for Class Members.

As part of our Countdown to the Holidays, are TCA’s top 10 class action settlements that paid out in 2020.

1. Kimpton Hotels Data Breach Settlement

Topping the list is a $10,125 check received by a TCA reader from a Kimpton Hotels class action settlement.

The settlement, worth $600,000, resolved claims that the company failed to protect customers’ information in a 2016 data breach.

Cyberattackers installed malware onto Kimpton Hotels’ servers, compromising the payment card information of nearly 150,000 consumers. Those consumers were left at greater risk for identity theft or unauthorized charges on their cards.


2. Indirect Purchasers Drywall Settlement

A drywall settlement yielded settlement checks worth $3,989.51 for some TCA readers.

The settlement resolved claims that drywall manufacturers took part in a price-fixing scheme that resulted in inflated drywall costs for consumers.

While the settlement was approved in 2018 and the claim form deadline was in 2019, class action settlement checks weren’t distributed until July 2020.

The Class included anyone in certain U.S. states who indirectly purchased drywall made by the defendants, their subsidiaries and affiliates in the U.S. between Jan. 1, 2012, and Jan. 5, 2018.


3. Behr DeckOver Resurfacer Class Action Settlement

TCA readers received checks worth $3,060 as part of a class action settlement involving Behr DeckOver.

The settlement resolved claims DeckOver deteriorated within months of being applied — in other words, much faster than advertised.

Consumers argued they would not have bought the product or would have paid less had they known it wouldn’t work as the company said it would.

Those who were eligible included U.S. customers who purchased DeckOver between Sept. 1, 2012, and June 27, 2018.

Individuals eligible for refunds were those customers around the country who bought Behr DeckOver between Sept. 1, 2012 and June 27, 2018.


4. Volaris Call Recording Settlement

Checks of $2,937 made their way to TCA readers thanks to a $3.2 million settlement with Volaris.

Volaris is a low-cost airline made up of two smaller companies, Concesionaria Vuela Compañía de Aviación, S.A.P.I. de C.V. and Controladora Vuela Compañía de Aviación.

The plaintiffs had claimed Volaris recorded customer phone calls without consent, in violation of California law.

Class Members included anyone in California who called a toll-free number to contact Volaris between June 21, 2016, and June 23, 2017, spoke to a representative, with the call being recorded.


Home Depot Settlement Check Mailed

5. Home Depot TCPA Settlement

TCA readers reported receiving checks for $2,441.84 as a result of a $4.35 million Home Depot class action settlement.

The class action lawsuit alleged Home Depot violated the Telephone Consumer Protection Act (TCPA) by making unsolicited phone calls to consumers.

The plaintiffs had claimed they were hit with a number of telemarketing calls after they signed up for free water testing. That signup allegedly resulted in Atlantic Water and Air getting access to Home Depot customers’ information.

Eligible consumers were those who received an unsolicited robocall from either Home Depot or Atlantic Water and Air from Oct. 16, 2013, through June 1, 2015.


6. Alarm.com Telemarketing Phone Calls Settlement

TCA readers received checks for as much as $2,223.47 in March thanks to a $28 million settlement in a class action lawsuit against Alarm.com.

Plaintiffs in the class action lawsuit alleged the company made telemarketing calls to consumers’ cellphones without consent.

According to the complaint, Alarm.com and Alliance, a third-party advertising service, made the calls, violating the Telephone Consumer Protection Act (TCPA).

Class Members had been expected to receive checks starting around $94, but that amount increased due to the number of valid claims that were submitted.


Solodyn generic settlement checks

7. Solodyn Generic Settlement

Checks for $1,575.64 began arriving in January for claimants in a Solodyn generic delay settlement.

The $43 million settlement resolved claims Medicis Pharmaceutical Corp. and Impax Laboratories violated state antitrust and consumer protection laws and became unjustly enriched by keeping a generic version of the antibiotic Solodyn out of the market in order to avoid competition.

Consumers claimed the drug companies injured them by forcing them to spend more money on the name-brand drug because they had no access to a generic version.


8. IC System Debt Collection Calls Settlement

TCA readers let us know in September they had received settlement checks for $1,371.53 from a settlement with IC System.

IC System had been accused in a class action lawsuit of violating the TCPA by using an auto-dialing system to make pre-recorded calls to consumers between December 2008 and November 2017.

The $3.35 million settlement deal was reached in August 2016.


Nissan transmission payments for Altima drivers.

9. Nissan Altima CVT Settlement

Checks for as much as $1,100 reached TCA readers’ homes in August as part of a class action settlement with Nissan.

The class action lawsuit had alleged some Altima vehicles had a defect that caused premature transmission failure, leading to variety of issues, such as power surges, stalling and abnormal sounds.

Consumers claimed Nissan should have offered repairs, but instead required vehicle owners and lessees to foot the bill themselves.

As part of the settlement, Nissan agreed to sending consumers $1,000 vouchers toward the purchase of a new Nissan or Infinity and to extend the allegedly defective vehicles’ warranty.


10. Evanger’s Toxic Pet Food Settlement 

Rounding out TCA’s list of the top 10 settlement payouts in 2020 is a $868.21 payout received by readers as part of the Evanger’s pet food settlement.

Other consumers who took part in this settlement without providing proof along with their claim reported receiving cans of dog food.

Evanger’s agreed to pay $545,500 to settle claims its food contained poisonous ingredients.

The plaintiffs, whose dog died after exhibiting neurological symptoms after eating the dog food, alleged the food contained pentobarbital, which is used in euthanizing animals, human executions and doctor-assisted suicides.

    I received $694.93 from TMCC Refunds via The Huntington National Bank, had to google (found nothing) called bank and verified its an Equipment Class Action from Toyota, I have a 2019 Corolla.

    I am so tired of all the spam calls about school loan help and calls about money owed to IRS and the help they can give you. We all know that these people should not be calling and represent themselves as working for these companies. I get them on my cellphone and home phone. Tired of them
