Consumers who purchased Behr DeckOver may be able to benefit from a class action settlement over allegations that the product deteriorates faster than advertised.

Under the terms of the Behr DeckOver Resurfacer class action settlement, consumers who bought/used the product between Sept. 1, 2012 and June 27, 2018 may be able to file a claim for a refund and for reimbursement for removal and/or repair of their deck. The product was exclusively sold at Home Depot for approximately $35 a gallon.

The Behr DeckOver Resurfacer class action settlement puts to rest allegations that the product, marketed at a premium to comparable stains, deteriorated on consumers within months of application.

The class action lawsuit claimed that consumers paid more for Behr DeckOver stain based on advertising that its thicker coating would last longer and require less upkeep than other deck staining products.

Although Behr admits no wrongdoing under the terms of the Behr DeckOver Resurfacer class action settlement, it has agreed to pay Class Members who can provide supporting documentation both a refund for the gallons of the DeckOver product used and for any repairs necessary.

The deadline to submit a claim for a refund and/or reimbursement for repairs is Feb. 27, 2019.

Class Members who wish to object to or exclude themselves from the Behr DeckOver Resurfacer class action settlement have until Oct. 15, 2018.

Who’s Eligible

Class Members include individuals nationwide who purchased DeckOver between Sept. 1, 2012 and June 27, 2018.

Potential Award

Varies depending on the amount of Behr DeckOver product purchased during the class period and cost of any repairs.

Proof of purchase and supporting documentation for any repairs.

UPDATE: According to the settlement website, the administrator discovered that some potential class members did not receive direct notice of the Behr class action settlement. These subclass members have been given an updated claim deadline.

UPDATE 2: On April 9, 2020, Top Class Actions viewers started receiving checks in the mail from the Behr DeckOver class action settlement worth as much as $3,060. Congratulations to everyone who filed a claim and got PAID!

    In searching for a way to remove my peeling deck over I became aware of the closed class action. I have used it on my deck and deck around pool and floor of screened in porch. The only area that hasn’t peeled is the screened in porch because it is out of the weather. It seems next to impossible to remove and replacing deck boards is only solution. About 750 sf of deck boards to replace would be $4000-$5000. Original installation was within the class time frame. Am I Out of Luck?

    Mine started peeling (not rotting) about 5 years ago.

    Yup, just learned of this now, after replacing 750 sq ft of our deck. All surface boards and railing showed little to severe signs of rot on a 7 year old deck.

    Ugh! How am I just learning about this now!!! We purchased several gallons & had our deck painted in Summer of 2017 AND again in 2018 as it was already pealing off in strips! Now my deck looks like old rotting barn wood. Even the paint that’s left has mold on it! We have tried multiple methods for removing the paint (including pealing off in strips! grrrrrr! sanding, scraping, power washing, & have had to replace several boards! I WANT THIS COMPANY TO REPLACE MY DECK… It is the focal point of our back yard & is the walk out entrance to our in ground pool. It’s a disaster. One company quoted us over $50,000 to replace it! WHAT!!! I just saw this & read on line that the class action suit has been settled. How did I never receive notice of this problem or law suit! Is it possible to open another suit.

    I myself just learned of this lawsuit. I just spent almost $2000.00 for wood to replace my rotten deck that was covered with deck over.My deck was only 1 year old when I applied it.Now it ,now you will fall thru it.

    We purchased Behr Deckover in the spring of 2019 – (after the settlement of this class action lawsuit we knew nothing about, or never would have purchased the product. It was applied by a contractor who did everything right for the optimal adherence. . Within a very few months, it started peeling, especially in higher traffic areas. We contacted Behr and they sent us new product, however there is no reasonable way to apply it without the labor of getting the old layer completely off, resanding the entire thing, and the additional labor of putting it on again, (or paying again to have it applied) with no guarantee it won’t peel again. So it is still peeling off (literally can peel it off in strips) and the wood is all wet and rotting underneath. What are we supposed to do when our purchase was after the class action lawsuit was settled? Our deck is ruined.
