Solodyn Generic Settlement Checks In The Mail

Top Class Actions viewers report receiving checks worth as much as $1,575.64 from a Solodyn generic delay class action settlement. 

Class Members included those who purchased or provided reimbursement for some doses of the antibiotic Solodyn and/or its generic equivalent between July 23, 2009 and Feb. 25, 2018.

There were two Classes who benefited from this settlement: a Class of consumers who purchased the drug and a Class of third-party payers.

The Solodyn generic class action settlement ended claims that Medicis Pharmaceutical Corp. and Impax Laboratories violated state antitrust, consumer protection, and unjust enrichment by keeping a generic version of Solodyn off the market to avoid competition. To settle the claims, the companies agreed to pay a $43 million. 

Consumers claimed that they were injured by the drug companies because, had they been able to purchase a generic version of the drug, they would have spent less money. Generic versions of drugs are often cheaper than the name brand versions, but consumers say they were forced to pay for name-brand medicine longer than necessary.

Allegedly, Medicis, the maker of Solodyn, created a scheme to “improperly restrain trade, and maintain, extend, and abuse” what consumers called a monopoly of power over over the drug on the market.

According to consumers, the drug company improperly listed a patent for the drug, so they could file infringement lawsuits against other companies who tried to release generics of the drug. This allegedly prevented other companies from releasing generics, so Medicis could continue to profit from the high name-brand prices.

The companies did not admit guilt, but agreed to settle the claims to avoid the continued costs and risks associated with litigation.

The two categories of Class Members included those consumers or third-party payers who purchased, paid for, and/or provided reimbursement for at least one of the following Solodyn drugs between July 23, 2009 and Feb. 25, 2018, in its generic or name brand form: 45mg, 55mg, 65mg, 80mg, 90mg, 105mg, 115mg, 135mg.

Class Members included these consumers and third-party payers in the following states: Alabama, Alaska, Arizona, Arkansas, California, Florida, Hawaii, Idaho, Illinois, Iowa, Kansas, Louisiana, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Oklahoma, Oregon, Rhode Island, South Dakota, Tennessee, Utah, Vermont, Washington, West Virginia, Wisconsin, Wyoming, the District of Columbia and Puerto Rico.

The deadline to file a claim was July 31, 2018.
