California Call Recording Laws
Privacy laws in the state of California assert that any telephone calls may only be recorded with the explicit consent of all parties involved in the call.
Accordingly, businesses and individuals who record a telephone call must only do so after obtaining the consent of all parties involved in the call, as required under California’s Invasion of Privacy Act.
Moreover, according to California’s wiretapping law, Cal. Penal Code 632., it is a “two-party consent law.” This law makes it a crime in California to record a private phone call or any other confidential communications unless all parties to the conversation consent to the recording.
California is known to have stricter laws under the Privacy Act than federal laws do in their entirety. Therefore, any individual or business based out of California must abide by the strict set of laws and guidelines deemed under California call recording laws. Moreover, the laws also assert that violations of California’s Invasion of Privacy Act do not require of the consumer be a resident of the state. In fact, it is sufficient for an individual to simply be in California when the alleged violation of California’s Invasion of Privacy Act, was made.
Calls made by many businesses use call recording for “quality assurance” purposes and to evaluate the performance levels of many of their employees. The warning is often mentioned live or may be made by an automated message machine.
Individuals can either consent to having the call recorded, or they can hang up. If they’re not given notice of the recording and a chance to decline consent, the business entity or company is in alleged violation of California’s Invasion of Privacy Act, and other privacy call recording laws.
An individual is also not required to verbally consent or deny the recording of the telephone call. In fact, simply staying on the line after an audio recorded warning for a recorded telephone call gives consent. If the caller doesn’t consent to the recording, they can hang up.
According to reports, many businesses or companies have had to pay settlements in the millions due to violations of California call recording laws. Per individual violation, the California Invasion of Privacy Act penalizes violators up to $5,000. The payout made from the settlements may also be more, as has been the case from several lawsuits.
TGI Friday’s is one of many companies who may be in violation of California call recording laws and other privacy laws. Critics suspect they may have violated such recording laws while calling and unlawfully failing to inform consumers in California of recorded telephone calls.
