A hearing is set for July in an Illinois federal court, in which a federal judge will decide if a proposed $10 million class action settlement against Suave Keratin Infusion Kit maker Unilever will be approved.
Consumers across the country are suing Unilever for injuries they allegedly sustained from the Suave Professionals Keratin Infusion 30-Day Smoothing Kit. The class action lawsuits allege that the company failed to disclose the potential risk of hair loss or scalp burns.
Numerous reports have surfaced by customers claiming that Suave Keratin Infusion caused hair loss and scalp burns, and they allege that the manufacturing company deliberately withheld this information to protect their profit margin.
So far, two women have filed a Suave Keratin class action lawsuit in Northern California against Unilever, accusing the company of negligence and false advertising. The women allege that the keratin treatment had harmful side effects that had not been mentioned on the product’s label, and that the product had been improperly recalled.
One of the plaintiffs reported significant hair loss from her crown and the sides of her head, and had been forced to cut off ten inches of her hair, and had to spend thousands of dollars on weaves, hair extensions, and treatments to repair the damage. The plaintiff claims after two years of using the product, she still is suffering the consequences of using the product.
The plaintiffs are seeking compensatory and punitive damages. They are also demanding that Unilever properly recall the product, remove its claims that the product is safe from their website, and provide an adequate warning to consumers about the product’s side effects.
At this time approximately 225,000 to 260,000 Suave Keratin Infusion Kits have been sold in the United States, which means that thousands of consumers may be eligible to file a claim against Unilever through the Suave Keratin class action settlement a new class action lawsuit being prepared against the company. The court will hold a Final Approval Hearing at 1:30pm on July 9, 2014, in Chicago, Illinois. The hearing will consider whether the class action settlement is fair, reasonable, and adequate for the means and purposes of the litigation situation.
If the Suave Keratin Infusion class action settlement motion is approved, it will require Unilever to pay for the plaintiffs’ awards and attorneys’ fees and expenses.
Overview of Suave Keratin Infusion Class Action Lawsuit Claims
The litigation movement for this product began six months after its release into the market, but it was recalled by Unilever without much explanation. The company labeled the kit as “discontinued” on their website, and instructed customers to contact Unilever if they had any additional questions about the product.
However, it has been reported that the product is still available on Amazon.com, indicating that the product had not been recalled properly, and some women had bought the product, unaware it was supposed to have been recalled.
To this day, Unilever has failed to acknowledge the consumer’s complaints, and have said the injury reports were results of the customers misusing the product. Even though the smoothing kit has been recalled, it is still being advertised as safe to use on the company’s website.
