SiriusXM lawsuitSirius XM Radio has offered to pay nearly $9.5 million to settle a class action lawsuit over allegations it violated telephone privacy and recording laws by failing to provide notice to customers who spoke with service representatives that their telephone calls were being monitored or recorded. If you placed a call or received a call from Sirius Satellite Radio between 2006 and 2010, you may be able to claim up to $1,000 or even $5,000 from the proposed class action settlement.

Plaintiffs in the Sirius call recording class action lawsuit, titled Kambiz Batmanghelich, et al. v. Sirius XM Radio Inc. and Stream International, Inc., allege that telephone calls with Sirius XM Radio, Inc. that were handled by Sirius XM’s customer care provider Stream International, Inc. were monitored and/or recorded without providing notice that the calls may be monitored or recorded. Sirius denies the allegations but has agreed to pay nearly $9.5 million to settle the class action lawsuit.

You’re considered a class member of the Sirius call recording class action settlement if you were in California, Florida, Maryland, Nevada or New Hampshire and:

(1) placed one or more telephone calls to Sirius Satellite Radio between July 13, 2006 and November 17, 2009, spoke with a representative on behalf of Sirius Satellite Radio, and were not provided with notice that the call may be recorded or monitored; and/or

(2) received one or more telephone calls from Sirius Satellite Radio between July 13, 2006 and February 1, 2010, spoke with a representative on behalf of Sirius Satellite Radio, and were not provided with notice that the call may be recorded or monitored; and/or

(3) placed one or more telephone calls to XM Satellite Radio between January 25, 2009 and November 17, 2009, to discuss music royalty fees or cancelling your XM Satellite Radio subscription, spoke with a representative on behalf of XM Satellite Radio, and were not provided with notice that the call may be recorded or monitored.

The amount of money you can receive from the Sirius call recording settlement will depend on how many people file claims; however, the maximum individual settlement amount for a class member who was in California is $5,000. The maximum individual settlement amount for a class member who was in Florida, Maryland, Nevada or New Hampshire is $1,000.

To receive any money from the Sirius class action settlement, you must submit a claim form online at www.callrecordingclassaction.com no later than September 10, 2011. You have until June 27 to exclude yourself and August 5 to object to the proposed settlement. A Final Fairness and Approval Hearing will be held September 12, 2011.

    Just came home today from vacation to find a check for the same, $699.20. What a nice surprise, also live in California. I don’t think it’s based on the amount of calls, I probably talked to them 2 – 4 times a year during the 4 years the suit spanned. This is the most generous settlement I’ve ever received. My guess is alot of people were leary to sign up to be part of the suit since they have to give their SS #, which made the amount greater for all of us that did.

    I received a check for the amount of $699.20 on Friday, February 17, 2012. I was wondering if this amount is based on one call or is it based on calls made and received, anybody out there knows

    Got $699.20, I was shocked to say the least, I forgot all about it. And to think I was reluctant to sign up for it since it asked for my SS #, now I know it is for tax purposes. ENJOY!!

    Just got back from the bank and a friend of mine who works there, spoke with the bank representatives and confirmed that the check is good and the funds are sufficient. Everyone is good to go who gets the check!! Enjoy!!

    I got $699.20 – was completely shocked, but I did run to the bank and cashed it!!!
