Sallie Mae Class Action Settlement

Sallie MaeIf you received an auto-dialed or pre-recorded call from Sallie Mae or any other affiliate or subsidiary of SLM Corporation to your cell phone between October 27, 2005 and September 14, 2010, you could receive between $20 and $40 from a class action lawsuit settlement.

 

Sallie Mae has agreed to pay $19.5 million to settle a class action lawsuit that alleges these automated phone calls violated the Telephone Consumer Protection Act (TCPA) because they were made to class members’ cell phones without their prior express consent. You’re considered a class member of the Sallie Mae TCPA class action lawsuit settlement if you received an automated call from Sallie Mae or one of SLM Corporation’s affiliates or subsidiaries on or after October 27, 2005 to September 14, 2010. The case is entitled Arthur, et al. v. Sallie Mae, Inc.

 

As a class member, you can receive the following benefits from the Arthur TCPA settlement:

 

(1) Monetary Relief: Class members who submit an approved claim form will be eligible to receive between $20 and $40, not to exceed $500, in the form of either a cash award or reduction award. To receive a cash award, you must have never been 180 days or more delinquent on a Sallie Mae loan payment and still have an outstanding balance. If you have, at any time, been 180 days or more delinquent and still have an outstanding balance, you’ll be eligible for a one-time reduction from your principal balance through the reduction award. If you’ve already paid off your Sallie Mae loan balance, you’re out of luck. Any settlement money left over after paying out the cash awards and reduction awards will be given to charity. All claim forms must be postmarked by February 26, 2011.

 

(2) Revocation Request: If you don’t want to receive future automated calls to your cell phone number from Sallie Mae or one of its affiliates, you must fill out and submit a Revocation Request form no later than February 26, 2011. There are two forms to fill out: one for those who have had some sort of lending or servicing relationship with Sallie Mae, and one for those who have never had such a relationship.

 

The deadline to opt out or object to the class action settlement is December 13, 2010. The Final Fairness Hearing will be held December 17, 2010. More information on the Sallie Mae Class Action Lawsuit Settlement, including downloadable claim forms, can be found at www.ArthurTCPASettlement.com.

    My cell phone is being auto dialed by Sallie Mae and we don’t even have a loan with them. The person they are trying to contact is not me so someone messed up on transcribing a number. I get 5 calls a day… When I call the 800 number back, a person who is obviously in another country says they will fix it. Not so far! I’m I. The process of finding out how to block this number on my cell if that’s possible!

    Our whole family has been overly harassed by Sallie Mae for years (two cell phones they called from 6am to 10pm seven days a week, at least three to four times a day.)

    I received so many theats for the Sallie Mae rep and the other companies who took ver the loans i tried to explained situation they didnt care. so rude I hope they get behind or something happens to them and their families.We all are one check away of being in trouble with the income change/

    This is a ridiculous settlement! Sallie Mae has agreed to take up to $40 off of the balances that they have inflated with phony late fees to the point where most people still owe as much or more than the original loan, after making payments for YEARS? That’s very big of them, I must say. And the calls continue, and the lies continue.

    I agree!! Fortunately my Dad could pay the $600/month, but he’s strapped after helping me through Medical school. We were 30 days past attempting to get a forebearance/delayed payment..SalleMae called every hour of the day..my Dad’s home also! What a bunch of Ponzie schemers!
    I go along with any of the lawsuits you have against them!! The schools are in on the Ponzie because they get a piece of that rock!! Mean and evil people!!!

    I still received a minimum of 6-8 automated calls from sallie Mae daily. I mean daily Monday thru Sunday as early at 7:45am every day and as late as 9:00pm on Sunday nights. I am sick of it.

    Sallie Mae Class Action Settlement
    I need a lawyer. Im in Utah. my stafford loan was only for 1.5 years and now the collection agency wants 30,000.00. from an original 5000.00 loan from 1 semester at the U of Utah and 3500.00 orginally from salt lake community college. I cant get work or a place to live. I am unable to even rent a room and stay with random friends. Ive deferred the college’s loan but the U of U will not let me defer that loan. the problem is the two schools suggested i sign a consortium agreement to attend both schools simultaneously at the time I was expecting to get into a prestigious dance program at the U. But at the end of the semester I got a notice saying I owed all 5,000 back to the U of U at once instead of paying it back upon graduation 3-4 yrs away still. i switched my major and now i cannot finish school until this is all settled. it happened during 2006-2007.
