Procera AVHA federal court has preliminarily approved a class action lawsuit settlement that will provide a $20 cash payment or 50%-off savings voucher to consumers who purchased Procera AVH, which the Plaintiffs allege was falsely advertised as helping to improve brain function.

The Procera AVH settlement will resolve a class action lawsuit, entitled O’Brien, et al. v. Brain Research Labs, LLC, that alleges Brain Research Labs (“BRL”) made false and misleading advertising and marketing statements that Procera AVH improves brain function. BRL sold Procera AVH primarily through direct marketing channels (such as infomercials and on its website), but also at select retail establishments.

BRL denies any wrongdoing, but has agreed to a class action lawsuit settlement to avoid ongoing litigation.
Class Members of the Procera AVH class action settlement include all U.S. residents who purchased Procera AVH from January 1, 2005 to March 23, 2012 through direct marketing channels or through retail. Purchasers who have received a refund or debit/credit card chargeback for the purchase price of the product at any time are NOT included in the class action settlement.

As a Class Member, you’re entitled to one of the following benefits if you submit a valid claim form postmarked or submitted online at www.gilardi.com/brlsettlement by August 10, 2012:

  • 50%-Off Savings Voucher: Each Settlement Class Member can choose to receive a savings voucher for 50% off the purchase of any of the following BRL products: Procera AVH, Ceraplex, Omega-3 DHA, Gabarest or 20/20 BrainPower Book. Each of these products has an MSRP of between $19.95 and $69.95 per unit.
  • $20 Cash Payment: In lieu of the savings voucher, Settlement Class Members can choose to receive a one-time cash payment of $20. This amount may be reduced pro rata if the amount of valid claims submitted requesting a cash payment exceeds $500,000.

    I THINK THAT AMERICANS ARE SO INUNDATED BY WHO IS GETTING SUED FOR WHAT, THAT THEY FAIL TO DO THEIR OWN RESEARCH.
    PEOPLE SO OFTEN WANT TO SIDE WITH WHATEVER IS NEGATIVE. I THINK ITS SAFE TO ASSUME; NONE OF THE PEOPLE THAT HAVE WRITTEN THESE COMMENTS HAVE EVEN DONE ANY RESEARCH ON THE MIND WHATSOEVER. LOOKS TO ME THAT THEY WOULD BE JUST A LITTLE MORE OPEN MINDED TO THE TRUTH GOING ON WITH ANY NATURAL PRODUCTS. THIS IS THE WAY WE WERE INTENDED TO FUNCTION. NATURALLY, NOT BY SOMETHING MAN HAS ALTERED.
    ARE THESE PILLS THE ANSWER? NOT NECESSARILY. THE ANSWER IS THE FOODS THAT WE PUT INTO OUR BODY’S IN THE FIRST PLACE. HOWEVER, EVERYONE WILL MAKE A DECISION BASED ON THEIR TASTE BUDS BEFORE THEY WILL BASED ON THEIR BRAIN AND BODY.
    SO CONSIDERING THAT, YES, I THINK THAT ITS A NICE CRUTCH TO WHAT REALLY NEEDS TO HAPPEN. EXERCISE YOUR BRAINS. SOMETHING MOST PEOPLE REFUSE TO DO ANYMORE.
    UNFORTUNATELY 90% OF FOLKS SIDE WITH THE FTA OR THE FDA, WHO CONTROL WHAT GOES INTO OUR BODIES, SO THEY CAN MAKE A PILL TO CURE IT.
    DOESN’T IT EVEN STRIKE YOU AS ODD THAT THE FOOD AND DRUG ADMINISTRATION ARE GOVERNED TOGETHER?
    MOST OF THOSE THAT ARE SIDING WITH THIS LAWSUIT ARE TAKING SOME SORT OF PHARMACEUTICAL THAT HAS A COMMERCIAL WITH MORE NEGATIVE SIDE EFFECTS THAN GOOD. WHY, BECAUSE THE GOVERNMENT SAID ITS OKAY. BUT THE GOVERNMENT SAYS THIS NATURAL CURE OR AID IS NOT. WHY CAUSE IT COULD CAUSE PEOPLE TO WAKE UP,AND START TO USE THEIR BRAINS AGAIN. WHICH WOULD DIP INTO HOW MANY PHARMACEUTICALS WOULD BE PURCHASED. THEY WOULD RATHER CALL IT A DISORDER, THAN A NUTRIENT DEFICIENCY.
    WE ALL HAVE BECOME SHEEP THAT NEED A SHEPPARD. AND INSTEAD OF USING YOUR MIND AS THAT SHEPPARD, YOU LET THE GOVERNMENT TELL YOU WHAT YOU CAN AND CANT DO, TAKE, EAT OR SAY. ITS COMMUNIST!
    WAKE UP PEOPLE!!!!!! I SAY ALL OF THIS WITH LOVE IN MIND.

    Haha march first and this phony infomercial is on right now, I thought it was a parody for a second when I turned it on, I am watching it for pure amusement factor & cuz I am stoned & find it quite funny lol way to get this off the TV ABC!! On a more serious notes these people are trying to take advantage of a lot of vulnerable people a lot of whom are up at this hour may suffer from health issues and are willing to try anything to feel better. (I know I am one of those people, I am have just tried to remain informed..because infomercials can be very convincing!) Shame shame of these people for trying to profit off other people’s misery.

    I’ve just received an order for a year’s supply…If there are law suits I feel like I’de better not start taking these…also I heard you can gain weight on these…That I do not wont….Other side affects also that can harm a person….Did not know all this until I got mine and started reseaching…..Can anyone tell me more about this lawsuit and all…

    I’ve just received an order for a years supply…After reading this about lawsuit I feel like I.de just better forget about it….I also read where this lady had took the pills for a year and loved them but she had gained up to three dress sizes in weight…I do not wont to do that….And also lots of trouble within her body was going on…I’m really afraid to take them now…Anyone that can shed some light on these pills.

    I was just trying to find that out myself. I am a senior on limited insome, and having some memory problems. I was hoping this would help, but now I am very hesident in buying it. Anyone out there used it, & if so what were the results? Thanks.

      I have purchased a year supply of Procera AVH probably a few years back and I did notice results after about my third month on the product. It seemed to help me with my short term memory issues (i.e. walking into a room and forgetting what it is you went there for). I also noticed it helped me stay focused and less stressed over the things that used to get to me. I do not recall any side effects and am going to place another order for a year supply. This is just my opinion.
