A North Carolina man has filed a Pinnacle hip replacement lawsuit against the makers of his hip replacement device claiming that it was defective and resulted in severe complications for him.
Plaintiff Timothy F., of Winston-Salem, N.C., filed this Pinnacle hip replacement lawsuit against DePuy Orthopaedics, Inc. He claims that “as a direct and proximate result of the defendant’s wrongful conduct in connection with the development, design, testing, manufacture, distribution, and sale of the DePuy Pinnacle Hip Replacement System and the Pinnacle Metal-on-Metal Acetabular Cup Liner,” he has suffered damages for which DePuy is responsible.
He believes that the Pinnacle hip replacement system with which he was implanted was not tested correctly and thus, caused him serious bodily injury. He says that he has incurred and continues to incur medical costs associated with his Pinnacle hip replacement.
According to this Pinnacle hip replacement lawsuit, Timothy was implanted with a Pinnacle hip replacement in his right hip on Sept. 10, 2002. In April of the following year, he was implanted with Pinnacle hip replacement in his left hip.
By the time he was implanted with both Pinnacle hip replacement devices, Timothy claims that DePuy knew that these devices were defective. However, this Pinnacle hip replacement lawsuit alleges, DePuy did not warn patients of the problems with their devices.
In November 2015, Timothy had to have revision surgery on his left hip. According to this Pinnacle hip replacement lawsuit, “Revision surgeries are generally more complex than the original hip replacement surgery, often because there is a reduced amount of bone in which to place the new hip implants. Revision surgeries also usually take longer than the original hip replacement surgery and the revision surgery has a higher rate of complications.”
In March 2018, Timothy says he was forced to undergo revision surgery on the other hip as well. He claims that his recovery from his multiple surgeries has taken a long time and has been both painful and costly. He believes that his injuries are permanent and that he will have to contend with them for the rest of his life.
Because of his revision surgeries, Timothy may be at risk for greater complications in the future. One study mentioned in the Pinnacle hip replacement lawsuit found that “14.4 percent of patients who underwent a revision surgery suffered from a dislocation compared with 3.9 percent of patients who underwent an original hip replacement surgery.” This study was performed at the Brigham and Women’s Hospital in Boston.
Essentially, those who had had revision surgery carried a risk four times higher of having dislocation than those who had only had an original hip replacement procedure.
He believes that he has suffered permanent physical injury, economic loss, pain and suffering and the need for a revision surgery because of DePuy’s negligence.
Timothy is bringing forth counts of failure to warn, negligence, design defect, manufacturing defect, breach of express warranty, breach of implied warranty, fraud and negligent misrepresentation.
