Petland class action lawsuit overview:

Petland Inc. sends unsolicited text messages to consumers in violation of federal and state law, according to a class action lawsuit filed June 16 in Florida federal court.

Plaintiff Flavia Covino alleges she received promotional text messages on her cell phone on June 9 and June 11 even though her number has been registered on the National Do-Not-Call Registry since 2005. She says she never provided Petland with express written consent authorizing the company to send her marketing text messages.

Petland sent the unsolicited text messages using an automatic telephone dialing system and a messaging platform that enabled it to blast text messages without human involvement, Covino alleges.

Petland did not disclose the name of the individual caller, the name of the entity on whose behalf the text messages were sent or a phone number or address at which the entity could be contacted, Covino says. This conduct allegedly violates federal law requiring sellers and telemarketers to identify themselves, according to the Petland class action lawsuit.

Petland class action says class members may each be entitled to more than $500 per unsolicited text message

The federal Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA) are intended to protect consumers from unwanted communications, including phone calls and text messages.

The TCPA and FTSA prohibit companies from soliciting consumers who have not provided express written consent authorizing such communications. The TCPA also prohibits companies from calling or texting phone numbers listed on the National Do Not Call Registry.

The Petland class action lawsuit claims the unsolicited text messages have caused class members harm, “including violations of their statutory rights, statutory damages, annoyance, nuisance and invasion of their privacy.”

Class members may be entitled to at least $500 in damages for each TCPA and FTSA violation, the class action lawsuit asserts.

Petland has faced at least one other class action lawsuit in the past.

In 2019, a former Petland employee filed a lawsuit alleging the companies knowingly sold sick puppies, putting pets and humans at risk of illness.

      Petland saved my life… i thought so at first. I was a current employee in training at the Katy Texas location. I feel singled out as gay man and because i didnt talk about sports or because I’m not a female and/or possibly because management didnt want to have sex with me, they let me go. I was in a car accident, a hit and run, few weeks into my training. Im still in the process of getting a rental. My 75 year old aunt had chest problems and went to the hospital. Management was aware of my car situation but was still pressuring me about something that was out of my control. I don’t feel treated fairly when 2 females at work fratenize with Management. Thomas, a supervisor writes love notes talking about how sexy or beautiful the girls are and how much he wants to kiss them and be quiet about it. Sara and Alisha are the 2 females involved in this. They show up late or leave the store hours at a time…. I hate to throw people under the bus but it’s not fair when my lively hood gets messed up while others continue to get fallacio from fellow staff members in the back office locked up… or even while it’s locked the supervisor would get felt up by Sara who would attempt to perform fallacio at times when it was unwarranted. Sara would make attempts to pull Thomas’s pants down and tried to do this while in the back office or wheb nobody is around. God as my witness, im speaking on what ive seen and what i was told. AND i know if i was to attempt to grab my supervisor privates through his pants, i would be fired or terminated. Especially if i was to try to pull his pants down. I don’t know who else to go with this information but I’m going to take it to the top because I was unfairly treated, I feel. Petland gave puppies away. I didn’t get one. Is it because I’m gay or it because I don’t have a bigger chest or because of what is swinging between my legs. All I wanted was my job back to work and make my living…. I was even told that they had no interest on hiring another male when I got hired. But they liked my interview. Females that apply will get hired on the spot depending on what you look like. Jarvis, another PC even would rate the females on what they look like without their knowledge and would make racial comments about black people and HE IS BLACK so that made me uncomfortable too. The only way to secure your job working for this company is to NOT be a gay man and to be a female that all guys want to sleep with. Period.
      They are understaffed so not all sick puppies get the 24/7 cared they need. The District Manger’s nephew started when I did and of corse gets the VIP treatment unlike myself. He was given ALL tools needed to succeed, and I was limited to the information and attention I was given. Something will be done about this.
