OTC Sex Enhancement Products Investigated for False Advertising

By John Curran

sex enhancement product class action lawsuitMen and women who are looking to increase sex drive and arousal may not be able to afford the costs of prescription medications that include Viagra and Cialis. Over-the-counter alternatives are available, but class action lawsuit attorneys are looking into claims that the products simply did not work as advertised.

The basic mechanism of action for many of these offerings is similar to those for over-the-counter diet pills that uses caffeine or other types of stimulants with the goal of increasing blood flow and increase in pulse rate. As the theory goes, this should improve the manifestation of sexual arousal even if users have reduced circulatory capacity due to age, smoking or other factors.

However, three products currently under investigation that work in a different pattern. They all contain L-Arginine, an amino acid that, according to advertisements for the VitalErotic Shot, synthesizes nitric oxide and therefore can improve blood flow. Each may contain other ingredients, however, but sex enhancement supplement lawsuit attorneys are focusing on:

  • The VitalErotic Shot which also includes an extract of Yohimbe, linked by natural health experts to improved sexual arousal;
  • Durex Play Utopia Female Arousal Gel; and
  • Excite Sensual Gel by LifeStyles.

The latter two are reportedly formulated for and marketed to women, while VitalErotic markets its product to both men and women and alleges that users “can be ready for action at a moment’s notice.”  While the website also contains the warning that the “statements have not been evaluated by the FDA” and that it is not intended to diagnose, treat, cure or prevent any disease, some consumers may have bought it for the claims and feel that they were misled by false advertising.

If you bought one of these OTC sexual enhancement aids and feel that they did not work as advertised, you may be able to pursue a legal remedy. While the three products have caught the attention of consumer advocates, other sexual enhancement aids may similarly not work as well as the maker represented and buyers may also be able to file a similar complaint.
