Kratom class action lawsuit overview:

A new class action lawsuit alleges that the companies behind OPMS kratom products, which operate as a single enterprise known as OPMS Kratom Enterprise, misled consumers about the addictive nature of their products.
A consumer claims the companies behind OPMS kratom products, which are derived from the leaves of the Mitragyna speciosa plant and sold in various forms, including powder, capsules and liquid extracts, engaged in false, misleading and negligent sales practices.
The consumer argues that while kratom is marketed as an all-natural product, it works on the same opioid receptors in the brain as morphine and carries similar risks of addiction and dependency.
“Kratom is perniciously addictive — on a whole different level than caffeine or nicotine — and it has sunk its hooks into tens of thousands of unsuspecting consumers and caused them serious physical, psychological and financial harm,” the kratom class action says.
The consumer seeks to represent a class of individuals who purchased OPMS kratom products in New York.
OPMS kratom companies allegedly operate as a single enterprise
The consumer argues that the OPMS kratom companies failed to disclose the risks of their products on their labeling, packaging or marketing materials. As a result, consumers who purchased and used OPMS kratom products were unaware of the potential for addiction and dependency.
“The defendants intentionally and negligently failed to disclose these material facts anywhere on the products’ labeling, packaging or marketing materials,” the kratom class action states.
The consumer further argues that the companies rely on the OPMS kratom products’ innocuous packaging and the public’s limited knowledge of kratom to get users addicted while reaping profits.
The class action lawsuit claims the companies are guilty of breach of implied warranty, unjust enrichment, fraud by omission, negligent misrepresentation and violation of New York’s General Business Law.
The plaintiff demands a jury trial and requests injunctive relief and an award of actual, statutory, compensatory and/or punitive damages for himself and all class members.
A similar class action lawsuit was filed against Ashlynn Marketing in 2023 over claims its Krave Botanicals-branded kratom products were sold in innocuous packaging that failed to indicate the serious nature of its addictiveness.

My son, who already has health problems that include having his colon removed due to ulcerative colitis used it for pain and became addicted, and it has really messed him up and I think changed his brain chemistry because he has completely changed. It is absolutely heartbreaking what this product has done to him!! I am so angry at the people selling this substance, ruining lives, and getting rich off it. This legal product is very addictive!!
