Top Class Actions viewers are starting to receive checks in the mail from a Ocwen Loan Servicing voluntary claim program established over accusations that the company sent misdated letters to borrowers that may have resulted in a foreclosure referral.
According to reader comments, Class Members who submitted timely and valid claims for the Ocwen misdated letters claim program started receiving checks worth as much as $2,000 on Oct. 24, 2016.
If you filed a claim for the Ocwen program, keep an eye on your mailbox because checks are on their way!
The Ocwen misdated letters claim program resolves allegations initially brought by New York Department of Financial Services Superintendent Benjamin Lawsky.
According to Lawsky, possibly hundreds of thousands Owen borrowers received a letter denying a mortgage loan modification with erroneous information.
The borrowers allegedly received the denial letter which informed the recipient that they had 30 days to file an appeal. However, the date on the letter was set more than 30 days prior to the mailing date so borrowers may have thought the deadline to file an appeal had already passed.
Class Members included Ocwen borrowers who received a misdated letter between Jan. 1, 2012 and Dec. 31, 2014 and were then referred for foreclosure.
Ocwen voluntarily set aside $100 million to compensate eligible Class Members.
The deadline to file a claim for the Ocwen misdated letters claim program passed on May 2, 2016.

Called yet again today (2/9/17), still under review and a letter will be mailed with their determination. So, now it looks like they have to determine whether or not I get a check? WTF?
Still in review…then they ask if I have any other questions, I ask do you know what the delay is, and her response is the same script I’ve been hearing since November! Why offer if you can’t answer??!!
Mine is still in review as well and I submitted November 2015! Is there someone we can contact directly to find out what is going on? why is it taking so long?
“still in review” (1/5/17)…no information whatsoever….maybe a consumer complaint with the AG or Federal Reserve can get us some answers!
I called again this morning, after being told that all checks/letters would be received by December 31, 2016. My claim is still “under review” because “these legal things take time”.
Hey Carol how can it take time when when there people was paid off top 5,000 now this is crazy how come they can pay there people and the homeowners got to wait till they fill like it and all they want to give the homeowners is a 300.00 and think they did something it’s not far
Top Class Action, can you provide any information as to what the delay is with Ocwen and is there now something we can do as consumers? We were originally told our claims would take up to 180 days from the day they received our claims, then it changed to 180 days from the May due date…now I’m hearing a new script from the call center saying they will go well into the new year before some of us get any kind of notice or check. Any advise?

We were approved for a refinance in September and we’re told to wait for a letter that would contain our new payment we received that letter the week of December 19th … The letter stated what our new payment would be and that it would start January 1, 2017 ….. of course we were pleased to see that however I opened up our local small hometown newspaper today and in it I see that our house is in foreclosure and due to be sold January 20th… talk about a shock, so I started researching an event on my phone for the last two hours and I cannot believe absolutely hands-down all the complaints I have read… From resending our information over and over and over to India to being reassured and told that our modification was approved I’m not really sure where to go from now … if there is anybody out there that knows of open lawsuits against OCWEN please contact me as we are going to try to get a loan through our hometown bank … if I don’t get answers out of OCWEN I’m going to the local TV station !!!
Hi Vicki- so sorry to hear about those circumstances! I would recommend calling Ocwen AND the attorney’s office that was assigned your foreclosure. From my understanding, if your loan is modified the foreclosure proceeding will be cancelled. The newspaper posting may have been submitted in error or because Ocwen delayed notifying the attorney’s office that the loan was modified (probably the latter).

still in review (12/22/16)…and was told to be patient with Ocwen because there were over 700k claims filed and being processed…I told the rep I was out of patience and would be calling back tomorrow!

Can you please tell me how to find out if I’m owed? They did this to me and my family too, but we had to foreclose. We didn’t know anything about all this until recently…
