Ocwen Loan Servicing has set aside $100 million to voluntarily settle accusations that borrowers may have received misdated letters from the company that resulted in a referral for foreclosure.

New York Department of Financial Services Superintendent Benjamin Lawsky initiated allegations against Ocwen of backdating potentially hundreds of thousands of letters to borrowers which was likely to cause them “significant harm.”

According to Lawsky, these borrowers received a letter from Ocwen which denied a mortgage loan modification and informed the recipient that they had 30 days to file an appeal. However, the letters were allegedly dated more than 30 days prior to the mailing date so that by the time borrowers received the denial, the 30 days to file an appeal had already passed. 

In a statement given by Ocwen on the Misdated Letter Claim Program website, the company says it “sincerely regrets any difficulty these letters may have caused and is committed to preventing such errors in the future.”

Borrowers have until May 2, 2016 to file a Claim Form to receive payment from Ocwen. According to the loan company, the majority of claims are reviewed and processed within 180 days after submission.

Who’s Eligible

Eligible Ocwen borrowers included in this program are all individuals who received a misdated letter between Jan. 1, 2012 and Dec. 31, 2014 and were subsequently referred for foreclosure.

Potential Award

$300 – $3,000

Individuals who believe they were negatively affected by the Ocwen misdated letter and submit a Claim Form are expected to receive a payment between $300-$3,000 per loan.

To receive payment from this program, individuals must file a Claim Form. Those who are able to attach copies of Ocwen letter(s) showing the misdated document, will have their Claim Form processed quickly. Regardless, Claims will be considered even if documents are not provided.

    I just received my check which contradicts the letter I received stating settlement amount is 1600 -3000, well I got a pissy check for 261.00, wow and they are to repay consumers of California for their bad debt practicing and incompetency, we as consumers are screwed by Ocwen, not to mention I had to do a short sale to avoid foreclosure on an approved modification, wtf is $261.00 versus losing a home after 10yrs. I will be calling this company bright and earlier Monday regarding this bs payment.

    I received my Notice of Conditional Denial today. It stated that I was not eligible to recieve a payment because their “review does not reflect that any potentially misdated letters were sent to you during the 1/1/2012 to 12/31/14 review period.” That took forever since I completed my form and sent it off the day I received it.

      How can you believe a company that “lost” multiple faxes and paperwork regarding a modification and missed multiple calls that were scheduled with a modification counselor. The whole thing is just another scam.They couldn’t keep track of things then and I certainly don;t trust them any more today

    My claim was filed in November 2015. I am getting the same story that the claim is under review, that a determination letter will be mailed out in early 2017. I was told the same in 2016 that I would receive a letter. Starting to wonder if this firm is using the money to gain the interest from the funds.

    This claim program was voluntarily created by Ocwen, and is not the result of any lawsuit or Settlement.

    A final determination regarding your claim has not yet been made. Your claim has been placed under additional reviews before we send out our final determination letters. While no additional, information is available at this time. we expect to send determination letters out soon.

      I called yesterday and got the same old BS plus an attitude. Which I responded to. I told them that Ocwen didn’t know what the F**K it was doing and that if they resolved this I wouldn’t need to call, and in regards to waiting I’ve already waited nearly 2 GODDAMN years.

      Maybe they should receive more irate calls to motivate these A holes !

        I call every day. I think they have some sort of flag on my file because they are becoming ruder & more difficult (if that’s even possible!) every time I talk to them. I’m really over this. Do we have any other options in dealing with them. It’s getting old. Very old.

    Called today (3/1/2017), and I was told my file is still under review for a determination letter. Soooo frustrating! They have told me this since early November. When I asked how I’m receiving the same info every time I call, I was told “this could take 5 years”. What?! She said payments will be made in early 2017, and I asked at what month are we considering early? She didn’t have an answer. She placed me on hold & said she would review with an attorney & that it could take 7-8 min, but she was back to me in less than 2 min and said they have the same answer, “thank you for your patience while you wait for a determination letter.” I should have known better when I completed the claim form. Nothing was ever timely with Ocwen….

      We should call AND email them every week until we get an answer. They started tis BS so let them get a taste of their own medicine!

    Has anyone gotten any letters or payments in 2017? I called today 3/1/17 and am in additional review still. Determination letters will be sent out early 2017.

      I call Lee Steetlement in February March April and May Lee Steetlement keep lieing saying they don’t have a list but they said checks will be mail out in June we will see I just don’t understand how can the lawyer who say they are for the homeowner pay his staff 5,000 off the top and the homeowners still have not received one dime and they are not the victims but we are it seem like it’s some funny crap going on the homeowners can’t get nothing but the lawyer at Lee Steetlement can relax with no worry cause they got there’s off the top but the homeowners got to wait till they fill like it.
