Nissan

Nissan has been hit with a class action lawsuit for hiding the fact that certain 2004-2006 Nissan Armada and Titan Trucks and Infinity QX56 vehicles contain an allegedly faulty and defective Delta Stroke Sensor, an integral electronic component that controls certain safety aspects of braking.

According to the Nissan class action lawsuit, these affected vehicles “post a significant and immediate safety threat to all users of such vehicles and to the public in general” because “the failure of this defective part results in the braking ability of affected vehicles being disabled to the point where drivers are, without warning and suddenly, unable to stop their vehicle within a reasonably safe time and distance, or at all.”

The lead plaintiff in the case, titled Brandon Banks and Erin Banks v. Nissan North America, Inc., et al., claims that as a result of the failure of the defective Delta Stroke Sensor in their Nissan, she drove through a red light in a busy intersection with her small children in the car because she was unable to brake the car. Thankfully, no collision occurred.

The class action lawsuit further alleges that Nissan knows about the defective part but hides it from consumers and fails to disclose the critical safety defect or issue a voluntary recall of affected Nissan Armada and Titan Trucks and Infinity QX56 vehicles.

The Nissan class action lawsuit is brought on behalf of a proposed class of all U.S. residents who currently own a 2004-2006 Nissan Armada and Titan Trucks or Infinity QX56 or who do not presently own an affected vehicle but incurred monetary loss caused by the failure of the Delta Stroke Sensor, including repair or replacement and other financial loss associated with such failure. It is seeking restitution and recovery of out-of-pocket repair costs, damages, and other relief.

    I have a 2005 Nissan Armada with approximately 61, 000 miles on it. My brakes does the same thing periodically, and I have let a representative know from North American Nissan about the brake problems, air bag system, as well as the problems with the rear a/c. The a/c problem was fixed by Nissan free of charge, and I do appreciate that, but like I told the nissan representative,””Air Conditioning is not going to matter if I am dead because I’ll be cold anyway!””
    This is a very dangerous and serious problem with the braking system, and should no longer be ignored by nissan or the America Government.

    I have 04 Armada and the brake light comes on while driving coming from San Diego. I have to drive very slow because everytime I press the brake it seems like the brake is not working and giving me sounds that I never heard. I don’t understand while there is no recall on this situation. I would like to know how to joint the lawsuit.

    Happened to me with my 04 Armada. Brake light comes on and a springing clutter noise happens. Happen with all my kids in the car. It’s really scary. Hope Nissan fix this problem for us

    I own a 2004 Armada, and experienced this for the first time last week. I was aware of the issue on these trucks via online. My truck has 145000 miles on it. Which I understand at that mileage things will fail. But, when its as common of an issue such as this, and a safety issue, this should be taken care of by the manufacturer. I work at a Ford dealer, and Ford, for instance, recalled 97-03 f series for fuel tank straps rusting and breaking. Now to me, if you have 300000 miles on a truck, that is 15+ years old, anything can happen. But Ford is still taking care of their customers. Come on Nissan, do what is right. Or, our wonderful government should mandate Nissan to go forward with a recall.

    This just happened to my 2004 Infiniti QX56 last night and after reading this I took it into the Infiniti dealership to repair today. I cannot drive my kids in a car knowing the brakes could fail at any moment! Every person I talked to in the service department was aware these cars have this problem. 2 people told me just to turn it off when it happened to solve the problem…which is not a feasible solution if you’re driving down the highway WHEN it happens. Cost to fix was over 1000.00.

    wow, I just had this happen to me again. I just left my house to take my daughter to school (kindergarden) and it happened as I was approaching the 15 mph school zone. As I prepared to slow down to comply with the schools speed limit, I felt the same thing as the previous times. The brake pedal went to the floor and it felt as if the anti lock brake system had engaged. thank God I turned the truck off and slowed the car down before anything bad happened. Way to go Nissan!!! imagine if your child was crossing in front of my truck when I experienced this malfunction today. Would you then get off your high horse and fix the death trap you created? THIS IS REDICULOUS!!!!!

    I have experience this problem also. 2004 Titan I ignored it cause it happened a few times early on but went away for years. Also when the truck was under warranty they dealer could not find anything wrong. Now it’s back and has happened 3 times in 3 weeks and of course the truck is no longer under warranty. Someone is going to be killed if this is not fixed.

    I have had this happen to me twice now. I have a 2006 Titan CC 4wd. I’m in Calgary, Alberta. Any other Canadians reading this have the problem? I’ve called the number of the lawfirm and left my name and number so I can be added to the list of reported cases.
