Nissan

Nissan has been hit with a class action lawsuit for hiding the fact that certain 2004-2006 Nissan Armada and Titan Trucks and Infinity QX56 vehicles contain an allegedly faulty and defective Delta Stroke Sensor, an integral electronic component that controls certain safety aspects of braking.

According to the Nissan class action lawsuit, these affected vehicles “post a significant and immediate safety threat to all users of such vehicles and to the public in general” because “the failure of this defective part results in the braking ability of affected vehicles being disabled to the point where drivers are, without warning and suddenly, unable to stop their vehicle within a reasonably safe time and distance, or at all.”

The lead plaintiff in the case, titled Brandon Banks and Erin Banks v. Nissan North America, Inc., et al., claims that as a result of the failure of the defective Delta Stroke Sensor in their Nissan, she drove through a red light in a busy intersection with her small children in the car because she was unable to brake the car. Thankfully, no collision occurred.

The class action lawsuit further alleges that Nissan knows about the defective part but hides it from consumers and fails to disclose the critical safety defect or issue a voluntary recall of affected Nissan Armada and Titan Trucks and Infinity QX56 vehicles.

The Nissan class action lawsuit is brought on behalf of a proposed class of all U.S. residents who currently own a 2004-2006 Nissan Armada and Titan Trucks or Infinity QX56 or who do not presently own an affected vehicle but incurred monetary loss caused by the failure of the Delta Stroke Sensor, including repair or replacement and other financial loss associated with such failure. It is seeking restitution and recovery of out-of-pocket repair costs, damages, and other relief.

    I have an 08 Armada and just experienced this problem last night. I had it towed to a local garage and he received the code that the Delta Stroke Sensor was bad. I noticed this suit is only for Armada’s made from 2004-2006. Would I be eligible to join this since I’m experiencing the same problem? Currently my truck is parked since I’m scared to death to drive it with my 3 kids.

    Just spoke to my Nissan Service guy and flashing the ECM will not fix this issue and in order to replace the Delta sensor its a $750-$900 job so its not like its a negligible cost to repair. How can we join in on the class action suit regarding this issue?

    This has happened to me driving out of our neighborhood unable to stop brakes grinding, brake light on. Scared the crap out of me! Finally was able to take it in to get it checked and to find out this is going on with this make & model of armadas is very disappointing. We invested in this truck for our growing family and now to scared to drive it and have to come up with the money to fix it. Bullcrap! The company that makes these death traps should fix there mistakes. If it were there family driving this model of truck they would feel the same way.

    We have recently been experiencing the same issues with our 2006 Nissan Armada. The first couple of times that it happened, the brake light NEVER came on. It was as if the anti-lock brakes were trying to kick in. I stopped by the repair shop and explained to him what was happening. He topped of the brake fluid and said if it continues to happen bring it back. Well today I pulled out of our driveway and at the first traffic light I came to, the brake light came on and I started experiencing the same problem. Every other time this has happened, I put the truck in park and turned it off and then back on which reset the computer. Today I did not do that because I was already on my way to the shop to get the hinges replaced on the automatic lift gate and I wanted him to be able to hook it up to find out what the problem is. Shortly after it was hooked up, it came back that the delta stroke sensor was bad. It was after that he told me there was a class action lawsuit against Nissan for this faulty part and he directed me to this site. I have read the comments above and will definitely be contacting the lawyer of the original claimants. I am so very thankful that we are experiencing this issue now as we are leaving for Florida in a couple of weeks and will be traveling with our 5 daughters. Although with a vehicle that sells for as much as this vehicle does, something this dangerous you would think there would have been a recall. Anyone that has had their vehicle fixed, what is the estimated cost for the part? I was told that the whole booster being replaced is the only fix for the problem.

    I have had the same brake problem after I purchased my Pathfinder/Armada back in 2006, I took the vehicle to the Nissan Dealership located in my town and they said that I had to pay out of pocket to replace the brake booster. I do not know what to do or who to turn to so I parked my vehicle. I have recently been using the vehicle and it has started with its brake failure again. Does anyone know who I can call or turn to for some guidance? Please help this is now my only vehicle and I travel with my children and now live in fear of a possible accident.

    When I first had the brake light issue, and no brakes, it was on start up in a café parking lot. I took it to the shop immediately, killed the engine, they diagnosed, found nothing, started it up and didn’t see it again. Took it to a dealership out of concern and they flashed the sensors, said they had it fixed about 2-3 months ago, 3/12. Tuesday morning 5/29/2012 @ 0430 hrs I started her up and headed out the driveway and it happened again, luckily at home this time. I killed the truck and started it about 5-6 times and could not get it to reset this time. I swapped out trucks so I wouldn’t be late for work and left it at home. I have since, called my son, had him disconnect the battery and left it off for 24 hours. We reconnected the battery, started up the truck, and brake light is still on, I can not get it to reset this time.

    Just happened for the first time at 70k miles. Brake light came on and the brakes didn’t work but shuddered and shook our 2005 Armada down a hill. Shut off and restarted and then was ok. Totally unsafe to drive until this is fixed. Hoping delta sensor is the fix.

    I’ve had the same brake locking issue with our 2005 QX56 about 10-15 times since owning the vehicle. Now, it seems like a normal occurence. I am also wondering why there isn’t a recall.

    We also had problems with our 2005 Armada coming down the mountain from Big Bear and we were blown off by Nissan. Again, last night with 8 people in the car, six of them 14 and 15 yr olds, the car would not brake. It was my sons birthday party. What a ghastly accident that could have been. I am prepared to have another conversation with Nissan Poway tomorrow.
