A Kentucky man recently filed a mesh hernia lawsuit against C.R. Bard, alleging that the manufacturer’s device caused serious injuries, including inflammation and tissue damage.
The plaintiff, Charles N., says he underwent hernia repair in August 2015, and was implanted with a Ventralight mesh system from C.R. Bard. Less than a year later, Charles was back in the hospital for an open hernia repair, according to his mesh hernia lawsuit.
During the surgery, Charles’ doctor allegedly found scar tissue and other tissue damage that showed evidence of inflammation. According to the mesh hernia lawsuit, Charles’ injuries were directly caused by his defective hernia mesh implant from C.R. Bard. The medical device manufacturer violated safety standards at the expense of its patients, the mesh hernia lawsuit alleges, leading to his injuries and subsequent pain, suffering, and monetary damage.
The mesh hernia lawsuit was filed on Feb. 28, 2018 in the U.S. District Court for the District of New Jersey. Charles filed the mesh hernia lawsuit on multiple counts, including manufacturing defect, design defect, failure to warn, negligence, breach of express warranty, negligent infliction of emotional distress, constructive fraud, among several others. Charles’ wife Jessica M. also filed on one count of loss of consortium from Charles’ injuries.
Through this mesh hernia lawsuit, Charles hopes for some compensation for his physical and mental pain and suffering, permanent impairment, economic damages, and more.
Charles is not the first patient to file a mesh hernia lawsuit over major complications, which can in some cases have long-lasting or permanent effects.
Basics of Hernia Mesh
Patients may be implanted with hernia mesh to reinforce a weak area or patch a hole caused by a hernia. C.R. Bard is just one of a number of manufacturers to make hernia mesh, along with Ethicon and others. Despite the popularity and widespread use of these devices, a growing number of patients implanted with hernia mesh are reporting serious hernia mesh side effects. In order to alleviate complications, many are forced to undergo hernia mesh removal.
Side Effects of Hernia Mesh
A number of complications have been associated with hernia mesh, including:
