TCPA robocalls woman on phoneA recently filed TCPA (Telephone Consumer Protection Act) lawsuit alleges numerous Navient harassing phone calls violated the plaintiff’s privacy and federal consumer protection laws. The TCPA lawsuit is being filed by a Mississippi woman, alleging she received numerous unwanted Navient harassing phone calls.

Plaintiff Delilah R. alleges she began receiving Navient harassing phone calls over an alleged debt, and that the company continued to call her despite being asked to stop. Delilah alleges she had received hundreds of Navient harassing phone calls which could be identified on her caller ID.

She had been reportedly receiving calls from the same number over the last four years, which indicates the company had used an automated dialing system. This is further evidenced by the fact that there was a brief pause before an artificial voice would speak during the few times Delilah had answered the phone calls.

Delilah repeatedly contacted Navient Solutions asking for the phone calls to stop and described them as harassment. On one of these occasions in March 2015, Delilah asked for the company to cease calling her. She also asked for the calls to stop after the company called asking for her daughter in September 2017.

Upon demanding the calls to stop again, Delilah was informed that she was cosigner of the alleged debt and the calls would not stop. Delilah has allegedly contended with multiple Navient harassing phone calls a day and has been forced to resort to legal action.

She is filing this TCPA lawsuit alleging Navient knowingly violated the federal privacy law.

Overview of TCPA Policy and Violations

The TCPA was first established in the early 1990s to help protect consumers against aggressive telemarketing tactics. Under the TCPA, it is illegal for companies to use automated dialing systems to look up and call numbers.

Furthermore, companies are prohibited from using artificial or pre-recorded voices to respond if the call is answered. A live representative must be able to identify themselves and the company they work for. The TCPA requires businesses to keep a do-not-call registry, which must be honored for up to five years.

Companies must gain express permission from the consumer before placing automatically-dialed calls, and must immediately cease calling when asked to. In addition to these policies, companies are not supposed to contact consumers outside of reasonable daylight hours between 8AM and 9PM.

Businesses that are found to be in violation of the TCPA could face financial penalties between $500 to $1,500 per violation. While these amounts of money are minuscule compared to profits that some big companies make, TCPA violations can add up quickly.

This could be the case for Navient Solutions LLC, with Delilah alleging that hundreds of phone calls were placed to her in the last four years. Delilah alleges these Navient harassing phone calls were meant to distress and pressure her into paying the debt, causing her mental distress and financial damages reflected on her cellphone bill.

Delilah is suing for all TCPA violations alleged in the lawsuit, along with any other relevant damages.

This TCPA Lawsuit is Case No. 3:18-cv-00005-SA-RP, in the U.S. District Court of Northern Mississippi, Oxford Division.

    Yes, I had the same, relentless calls dating back to early 2000,s. Every time I tried to work with them they kept upping the monthly payment. I quit answering the phone.

    I Have seen money paid be aplied to loans with lower interest rates while loans with higher rates remain unpaid. Not to mention the hundreds of robo calls I have recieved, after I requested that the phone calls stop and to send me paper statements. I also have probably 12 different phone numbers call me on a regular basis. Its constant untolerable harrassment……
