Mercedes-Benz AMG V8 Engine Class Action Lawsuit

Mercedes-Benz AMG. Photo courtesy Mercedes-amg.comMercedes-Benz is the target of a class action lawsuit that alleges the V8 engines in its AMG vehicle line have underlying problems that make them prone to premature wear, causing major engine damage and sometimes total engine failure.

Los Angeles Resident Cedric Chan alleges in the Mercedes-Benz AMG class action lawsuit that after obtaining his AMG he experienced problems with loud ticking noises under the hood and a drop in oil pressure. The ticking and drop in oil pressure, he says, was the beginning of the AMG engine’s destruction.

“Although the destruction of the defective parts took place during the warranty period, Defendants still did not replace the defective parts under warranty,” the Mercedes-Benz V8 engine class action lawsuit states.

The problem, the lawsuit continues, is that the defective AMG engines are manufactured using soft camshaft metal that is improperly heat treated and/or improperly offset, making the camshaft prone to premature wear. Mercedes-Benz has known about the defect since at least 2007, when a service bulletin was released, but failed to issue a proper recall.

“Due to the premature wear, the camshafts, valve lifters, camshaft adjusters, valve tappets, gaskets and bushings all have to be replaced. The cost of replacement is thousands of dollars, which was passed on to Plaintiff, because Defendants did not issue a recall for the defect, even though they knew it to exist,” the Mercedes-Benz AMG V8 engine class action lawsuit states. “The premature wear can cause eventual catastrophic engine failure, resulting in a necessary replacement of the entire engine block costing tens of thousands of dollars.”

The Mercedes-Benz V8 engine class action lawsuit is brought on behalf of all current and former owners and lessees of 2006-2011 Mercedes-Benz C63 AMG, E63 AMG, S63 AMG, CL63 AMG, CLS63 AMG, ML63 AMG, CLK63 AMG, R63 AMG, and SL63 AMG models equipped with AMG M156 6.2 liter V8 engines that were sold or leased in California.

It is seeking class certification, compensatory damages, restitution, punitive damages and more for violations of the Magnuson-Moss Act, breach of express warranty, breach of implied warranty, and breach of implied covenant of good faith and fair dealing.

    Is it to late to join the class action law suit? I own a 2008 S63 AMG with only 42,700 miles. I ordered the car new and purchased it. The car has been expertly maintained at the dealership and is in pristine condition. However, the engine began a whining..grinding noise about a month ago, it sounds horrible… I have taken it to the dealership on 3 occasions to be diagnosed as a precautionary measure only to be told that I should not worry about it. I was told that it is common for cars to sound different as they age. I feel like this would be acceptable if the car had the typical 80,000 plus miles, but with almost half the typical miles I feel that this is not an acceptable answer. I know how this car drives and sounds…I feel strongly that this is merely a time bomb. I am waiting for the transmission to go or something worse.

    I am going to look at a 2008 CL63 Mercedes this weekend with 49,000 miles on it. Having just read about these suits against Mercedes, but not the final outcome, am VERY interested. Anyone with help or advice regarding these V8 engines and excessive oil consumption or early failure, I would appreciate your input. I am a senior, and this would likely be my last interesting car in this life, but am having second thoughts now. I am at nixthedoggie@aol.com if you care to help before I do this!!

    I have a 2003 E320 Mercedes-Benz that seems to have a timing issue when I come to a stop it sometimes revs up and when I come to a left turning stop it sometimes stalls completely which has been very frightening if there is oncoming traffic and I have not completed my turn. Is there a class action lawsuit that I can enter with these problems? I still have 3 more years to pay and it is very concerning to me to have these issues and uncertainties.     I bought a used 2008 Mercedes Benz S63 AMG last year (2013). When I purchased it from a dealership it has exactly 60k miles on it and appeared to be in mint condition. It has been 12 months and less than 10,000 miles and the car has been in the Mercedes Benz dealer shop literally a dozen times with in excess of $15,000 in repairs and it seems to never end. I am convinced Mercedes makes the worst vehicle ever or I got a complete lemon! If there is a lawsuit I can join I can guarantee my car has had almost every part break or malfunctioning. Oh and that extended warranty I paid thousands for covers nothing!

    I have a 2010 ML63 and it has spent the majority of this year in the shop. First it was head bolts that they supposedly replaced. I had to pay half the costs after quite a bit of arguing since they weren’t going to do anything at all initially and now it’s back in the shop and needs the engine reconstructed because the tensioner guide broke off and destroyed the engine. This is a 100k+ POS and MB has no problem stealing from its customers and pawning off this crap under the guise of a luxury, high performance vehicle.

    I have a 2006 E350 4-Matic with the above mentioned cam problems. I have spent in the excess of $6000 on repairs. Please include me in the class action lawsuit.

    I have a 2007 R350, and about 6 months ago I had to replace a chip that according to the dealership always happens in these cars. It was $1400, and I was told IF Benz ever recalls you will get it back. Now, I have been quoted $6000 for this same engine issue, and again being told” it happens in all Benz R350, eventually Benz will have to recall it.”

    I’m responding to an article I just read, regarding problems with the M 156 6.2 L V8 engine. I have a Mercedes Benz S 63 AMG 2009 and I expericenced total engine failure. I was told, I would need a new engine. I purchased my vehicle in December 2008 off of the showroom floor in Pembroke Pines, Florida.       2011 c63 with 28000 miles, 5 months out of factory warranty, total engine failure. diagnosis from authorized AMG dealer, Hydrualic lock caused by fuel injectors sending too much fuel for combustion. Repair estimate: $38,000.00. UNACCEPTABLE! My research indicates this would/could be caused by a faulty crankshaft position sensor. : One Man One Engine, The best or nothing what a joke!!!!

    I have exactly the same problem as these cars mentioned in the lawsuit; my car is a 2004 CLK55AMG with premature engine failure and is in the Mercedes shop right now and I feel Mercedes should step up and pay for the repairs as this has obviously been an issue for longer than is publicized. My camshafte, rocker panels need to be replaced, both heads are scored; this engine should be lasting alot longer than this since my last car, a 300 CE and had 430,000kms on it. Would like to hear from others or find out if I can also join in this lawsuit
