Maytag/Whirlpool Service Contract Class Action Lawsuit

MaytagA disgruntled customer has filed an amended class action lawsuit against Maytag Corporation (now a part of Whirlpool Corporation) and its service contract administrator Service Net Warranty, claiming the companies engaged in deceptive and unfair trade practices by refusing to honor their service contracts.

“Thousands of consumers — or perhaps hundreds of thousands — were ripped off by Whirlpool and Service Net when those companies did not repair or replace faulty appliances per the terms of the service contracts,” said the Plaintiff’s attorney.

According to the amended class action lawsuit, Plaintiff Mark Sherman purchased a Maytag clothes dryer along with a three-year service contract that promised to repair or replace the appliance if it failed. The contract also gave the warrantor the option of “buying out” the contract by either refunding the original purchase price less the amount of claims paid, or replacing the dryer with a comparable product.

Instead of refunding the original purchase price or replacing the dryer, the Maytag/Whirlpool service contract class action lawsuit alleges that Maytag and Service Net told Sherman that he was only entitled to a refund of the present value of the dryer, minus the cost of the repairman’s visit.

According to Sherman’s attorney, “That is absurd, since the point of buying a service contract is to avoid the cost of repair.”

Sherman alleges in the Maytag/Whirlpool class action lawsuit that the companies failed to fulfill the terms of the service contract by improperly administering buy-outs. As such, the class action lawsuit alleges that the dryer’s buy-out, and buy-outs given to similarly situated consumers, constituted breach of contract, unjust enrichment, and a violation of the federal Magnuson-Moss Warranty Act.

“Consumers purchase service contracts to ensure that they will be protected should an appliance need repair or replacement. Corporations and service contract providers need to be held accountable to the terms of the service contracts,” said Sherman’s attorney.

The case is Sherman v. Maytag Corporation, Whirlpool Corporation, and Service Net Warranty, LLC, Case No. 3:11-cv-01010-JBA, U.S. District Court, District of Connecticut.

    Would like to join the Maytag class action lawsuit. Our bravos XL died after 2 years. Repair man said it needed a new control board. He said it is not worth fixing.

        i have the bravos xl. it takes hours to wash?? never worked right and doesn’t even clean the clothes? i’d rather go to the laundry mat getting ready to replace .. it was a huge waste of money and time. i also replaced a very old maytag that still cleaned well, short run time but it got really noisy? i feel like an idiot

    Bought a Maytag Bravos & have had NOTHING but problems. Replaced parts, etc.. now it doesn’t work at all. WASTE of money ! Maytag needs to reimburse folks for their horrible products !

    I’m really pissed off. Our new French door frig just out of warranty is totally broken regulating a $1000 to repair. When u spend 4000 for a fridge u hope it last longer than 3 years 1 month. It’s thanksgiving next week and I have company coming in this week. I have no frig not can SEARS repair it till next week. sEARS will not over night the part. I want to join the class action suit!!

    How can I add my name to this lawsuit, my Maytag Bravo machine and it stopped spinning and agitating. I called Maytag they sent out a repair man, who basically ripped me off. I had to pay $108.53 for a service call and my machine is still broken. He states it is the control board which under the warranty the motor is under a 10 year warranty but no the control board. The repair man told my husband that Maytag basically makes products to purposely break down after a few years so that we can spend money on repairs and or a new product

    I bought a Maytag top of line top load dryer 2 years ago now when I run it smells like a dead animal. We have even paid Maytag for a service call still smells horrible. Nothing in lines or in u it all been checked out the smell is so bad it permeates the whole house. I dont think I should have had pay to have a service call for only 2 years old. And they can’t figujre out why smells so bAd. Not in drum luckily clothes don’t smell just house. Are there any class action suits?

    continue: had renewed warranty for 3yrs and told me I had no more money left on my warranty because of the repairmen 1st visit.
