A class action lawsuit settlement has been reached with Louisiana-Pacific Corporation (“LP”) over selling allegedly defective composite decking and railing materials. If you’ve ever owned a property that had ABTCo, LP, Veranda or WeatherBest decking or railing materials installed, you may be eligible to claim money or receive a free replacement of the products from the class action settlement.
The LP decking class action lawsuit settlement resolves a lawsuit, entitled Carol Postier et al. v. Louisiana-Pacific Corp., that accuses LP of manufacturing defective composite decking and railing materials that prematurely failed and did not meet up to reasonable expectations. These allegedly defective composite decking and railing materials were used on homes, residences, buildings and other structures throughout the United States, and were sold under the brand names ABTCo, LP, Veranda and WeatherBest.
You’re considered a class member of the LP decking settlement if you own or owned any of these decking or railing products. There are several ways you can determine if you have the right decking:
(1) The materials will be stamped or tagged with the names ABTCo, LP, Veranda or WeatherBest.
(2) Your purchase or repair documents (including receipts, warranties, bills of sale, or brochures) may say LP composite decking and railing materials were installed on your property. The contractor or company that installed or repaired your composite decking and railing materials may also know whether LP composite decking and railing materials were installed.
(3) If you are still unsure if you have the correct decking, go to www.LPdeckingclass.com for further information and pictures of composite decking and railing materials to help you identify them.
The LP decking and railing class action settlement provides three options for filing claims. If your deck or railing shows signs of deterioration, LP will replace the entire deck and/or handrails. If there is no deterioration to the deck or handrails, but there is damage, LP will offer to pay you a percentage of the repair costs. The deadline to file a claim for the LP deck and rail settlement is the same date as the expiration of the Warranty Period applicable to your deck or railing product. For example, if you purchased LP WeatherBest decking with a 10-year warranty in June 2005, your claim-filing deadline would be in June 2015.
The deadline to exclude yourself or object to the settlement is December 31, 2010.
