Kia and Hyundai drivers: Who’s affected?

Are your insurance payments for your Kia or Hyundai vehicle excessively high? If your car wasn’t the subject of a theft or attempted theft, you won’t be reimbursed in a pending settlement for any increased insurance premiums due to the theft risk for your vulnerable vehicle. You may want to opt out now.

A current class action settlement will NOT reimburse you for the increased insurance premiums you may pay on your owned or leased Kia or Hyundai vehicle due to the increased risk of theft. You may want to opt out and instead join a mass action investigation that will seek the reimbursement you deserve.

Thanks to social media, thieves mastered the simple technique of stealing Kia and Hyundai vehicles in seconds that do not have an engine immobilizer. Even if your car wasn’t stolen, insurance companies may consider your vehicle a high risk, especially considering drivers reported 11.2 per 1,000 insured Kia and Hyundai vehicles stolen in the first half of 2023, according to CNN.

A pending class action settlement provides you with anti-theft options to lessen the risk but does not include compensation for increased insurance costs you may have incurred even though your vehicle was not the subject of a theft or attempted theft,. A new lawsuit will seek additional compensation for those costs.

Do you qualify?

If you own or lease a certain Kia or Hyundai vehicle deemed more susceptible to theft, that was not the subject of a theft or attempted theft, you may want to opt out of a pending class action settlement and instead seek compensation that also covers high insurance premiums.

Please fill out the form on this page for more information.

How to opt out

To join a new lawsuit that seeks full compensation for the additional insurance costs you may pay on your Kia or Hyundai vehicle even though it was not the subject of a theft or attempted theft, you must first opt out of the pending settlement by May 3, 2024. If you have an eligible vehicle, you should have received notice of the settlement. You can learn more about the class action settlement by visiting www.kiatheftsettlement.com or www.hyundaitheftsettlement.com.

To join a mass action investigation that would seek compensation for high insurance rates even though your car was never stolen or broken into, please follow the instructions on this page.

Recalls and reliability

Generally, Hyundai and Kia vehicles have lower price points than other comparable vehicles. While they are separate companies, Hyundai owns about a third of Kia, and they share many of the same parts from outside suppliers.

In 2023, the two companies recalled more than 3.3 million vehicles from the 2010-2017 model years because they might catch fire, according to Consumer Reports. Prior to that, the companies issued recalls for some models that had a possible transmission defect.

Yet, surveys from J.D. Power show an increase in the manufacturers’ reliability rating, with Kia near the top of the list, according to Capital One Auto Navigator, which attributes the climb to the automakers’ willingness and ability to make “quick design changes as problems arise.”

That’s likely of little comfort for those whose vehicles can be easily stolen and whose insurance costs increased due to increased theft and attempted theft rates added unexpected costs to a purchase made to save money.
