Kaz Heating Pad Class Action Settlement
By Kimberly Mirando
UPDATE: A federal court approved the Kaz Heating Pad Class Action Lawsuit Settlement on June 11, 2013.
A proposed class action lawsuit settlement has been reached with Kaz USA Inc. over allegations it deceptively labeled and advertised its electronic heating pads by omitting the fact that the pads could burn consumers if used a certain way. California residents that purchased a SoftHeat, SmartHeat, Dunlap or Kaz electric heating pad within the last seven years can receive up to $20 from the class action settlement.
The Kaz heating pad settlement will resolve a 2010 class action lawsuit, titled Beck-Ellman v. Kaz USA Inc., that claims the packages for Kaz heating pads were misleading and lacked information that a consumer would use to determine whether or not to purchase the product. Specifically, the packaging did not state that the heating pads could cause burns when used in common positions or ways. The class action lawsuit further claims that Kaz violated various state and federal warranty laws by selling a product that cannot be used normally, such as while sleeping or lying on your stomach.
Kaz denies the allegations but has agreed to pay between $1.45 million and $2.7 million to resolve the litigation. In addition, the company will make several changes to the boxes and packaging for its electric heating pads, including removing pictures of models lying on the pads and adding a warning not to sit on or lie on the pads.
Class Members of the Kaz heating pad class action settlement include all California residents who purchased a Kaz-manufactured or distributed electric heating pad for personal, family or household use between October 13, 2006 and January 7, 2013. These heating pads or their packaging stated: “Kaz,” “SoftHeat,” “Dunlap,” or “1-800-477-0457.”
Class Members who submit valid Claim Forms can expect to receive approximately $10-$20 from the class action lawsuit settlement. The amount of money you will receive will depend on how many people file valid claims.
The deadline to submit a claim is June 17, 2013. A Final Fairness Hearing is scheduled for June 10, 2013.
