Vivint class action lawsuitVivint mandatory training class action lawsuit lawyers have launched an investigation into whether or not the company adequately compensated employees who underwent seminars, lectures or other meetings in order to continue on their jobs.

The Department of Labor has established a four-step procedure for determining whether or not such activities must be considered as part of a worker’s hourly pay. In order for it to be uncompensated, “it is outside normal, it is voluntary, not job related, and no other work is concurrently performed,” according to a fact sheet discussing hours worked under the Fair Labor Standards Act (FLSA).

Just as companies cannot ask employees to clock out for breaks or before their shift is done, any mandatory training that does not meet all of those four standards must also be included in a worker’s pay. It is believed that Vivint may have possibly not done so in certain instances regarding its training. It is also possible that travel costs may have been incurred above and beyond those accounted for by the FLSA and Department of Labor regulations.

Vivint is a company with international operations that began as a home security company in 1997. It has expanded to provide home automation related to home security as well as solar panel installation in California and other states.

However, the company has also been linked to unpaid training class action lawsuits before. It was accused of robocalling cellular phones in violation of the Telephone Consumer Protection Act in two separate Vivint class action lawsuits, and the company has also either been charged or settled lawsuits regarding deceptive marketing practices or fined for code violations by 14 states.

The potential Vivint lawsuits would be similar to unpaid wage class action lawsuits regarding misclassification of workers as either exempt or subject to a tipped wage when they are not performing those kinds of duties. However, many people are only becoming aware more recently of the full scope of their rights as workers, including pay for mandatory training.

    I have a car that is totaled and a tree fell on it while driving progressive insurance will not pay and their is alot of this going on with them, because it’s act of god they claim.

    also do not go to clearchoice dental I had implants put in had the resting plates in they cracked broke got a 2nd temporary pair and now they are coming out of my gums and they won’t do anything without 17k to pull these out with surgery and put another set in or just regular dentures. I’m so sick from these I can’t even eat and my whole face is hurting sore and giving me constant headaches. got a 2nd opinion they called clearchoice and that Dr said what was happening and said I had to go back to clearchoice for them to pull them out and try to fix them, or get my money back or come back once pulled then they could help me. thank god another dr. agreed with me and actually called them. NIGHTMARE!!!!!

    Capital one sent me a pre qualified letter for a credit card. I applied and was approved. The disclosure states that it won’t affect your credit score. However, I rejected the offer and my credit score dropped 1 point. It is now on my credit as a hard inquiry.

    I work for the State of New Jersey and was forced to take the covid vaccine and booster shot or face termination. I have 23 years of service, however, if you retire with less than 25 years of service your pension is deferred until you are 60. I’m aware of hundreds and thousands of State workers in New Jersey who were forced to receive the experimental vaccine or face termination.

    At & t In California are adding fees and surcharges to your bill if you don’t look at your bill the fees that they charge they are getting away with adding those fees and with all the customers that they have that money adds up every month I noticed in my bill is up sometimes a dollar sometimes cents but that still makes a difference with no explanation when I call for an explanation I get some lame excuse.

    Keriug sold drink works machine and then discontinued the machine and pods. Rendering the machine useless. I just heard of the discontinuation today they allowed consumers 2 month to file for reimbursement of the machine. This was not ample time or notification since the pods were still being sold until inventory was out. Although I registered the purchase with keriug I was never given notice about the discontinuation. Product was discontinued in December only given to February to get reimbursed. Company still sold pods and other items to consumers.

    2016 Nissan Altima shakes at 60 mphs and gets worse anything over 60mph. Took it to dealership a few times but can’t be fixed. I have a certified pre-owned with 7years/100,000 miles warranty but lemon law lawyers won’t take my case.

    Morettis in Mchenry does a lot of illegal things. I wasn’t paid minimum wage, they unjustly fire people without talking to you, they don’t make you have your food certificate or basset training, and they don’t label their food or sauces

    A student living apartment in flagstaff named, Elara at the Sawmill. Has been making false promises to students to which they have yet to uphold. They have stated there will be a personal shuttle picking them up from the apartment to campus, there isn’t a shuttle the students are now having to walk. The apartment is charging students a full month worth of rent but moved the students in past the date of move in that was stated on the original lease. The apartment also promised compensation on Fridays they do not pay it unless the student is in the office asking for it. Nothing in a timely manner as stated on their documents.
