HelloFresh class action lawsuits overview: 

  • Who: Consumers filed several class action lawsuits against meal kit company HelloFresh this year. The U.S. Department of Agriculture’s Food Safety and Inspection Service also issued a public health notice over ground beef products in some of its kits. 
  • Why: Claims against HelloFresh revolve around its auto-renewal practices, online website accessibility and promotional text messages. The public health notice was in regard to potential E. coli contamination. 
  • Where: HelloFresh is available to consumers in the continental United States. 

Meal kit company HelloFresh faced several consumer complaints this year over claims revolving around its auto-renewal practices, promotional text messages and online website accessibility. 

The U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS) also issued a public health alert earlier this month over concerns that ground beef products in some HelloFresh meal kits were contaminated with E. coli.

The FSIS did not issue a recall for the HelloFresh meal kits because the products were no longer for sale, it says. The FSIS advised consumers to dispose of the meal kits if they already purchased them. 

“Consumers who have purchased these products are urged not to consume them. These products should be thrown away,” the FSIS says. 

HelloFresh accused of breaking the law with promotional texts

A class action lawsuit filed against HelloFresh earlier this month claimed the company sent unsolicited promotional text messages to consumers without their consent. 

A Florida resident behind the class action lawsuit argues that HelloFresh violates the Florida Telephone Solicitation Act (FTSA) by allegedly sending consumers unsolicited marketing text messages. 

The FTSA prohibits a business from transmitting unsolicited text messages and sales calls to the telephones of Florida residents, according to the HelloFresh lawsuit. 

HelloFresh allegedly uses an automated system to send the promotional text messages with the resident arguing that they invaded his privacy and intruded upon his seclusion. 

HelloFresh subscribers enrolled in auto-renewal program without consent, class action says

Also this month, HelloFresh faced claims that it illegally auto-renews its customers’ subscriptions without providing them with proper notice or being given consent to do so. 

The HelloFresh consumer behind the class action lawsuit argues the company runs an “automatic renewal” scheme that violates California’s Automatic Renewal Law, among other things. 

HelloFresh is accused of enrolling consumers who sign up for the company’s services into a week-to-week auto-renewal program that results in weekly charges. 

“In doing so, Defendant fails to provide the requisite disclosures and authorizations required to be made to and obtained from California consumers under California’s Automatic Renewal Law (ARL),” the HelloFresh lawsuit states.

The HelloFresh consumer claims the company is legally required to obtain affirmative consent before enrolling a new customer into an auto-renewal program in addition to providing them with a clear presentation of its terms. 

HelloFresh allegedly failed to make website fully accessible for blind, visually impaired 

A consumer filed a separate class action lawsuit against HelloFresh in May, arguing the company failed to make its website fully accessible to individuals who are blind or visually impaired. 

The consumer behind the complaint argues HelloFresh violates the Americans with Disabilities Act, among other things, by allegedly denying individuals who are blind or visually impaired with equal access to the goods and services that the company provides. 

HelloFresh has “thousands of access barriers” on its website that make it “difficult if not impossible” for individuals who are blind or visually impaired to successfully navigate it or even complete a transaction, the HelloFresh lawsuit alleges. 

The consumer argues that individuals who are blind or visually impaired must “rely on sighted companions to assist them in accessing and purchasing” from the HelloFresh website.

    I have had multiple issues with them delivering rotting ingredients. The last box which was an auto subscription that i had concealed but they reinstated it without my permission. On top of that, the meat was thawed and the pork was opened and dripping into all the other ingredients. They refused to do anything but give a credit on the next box. WHICH DID NOT HAPPEN. Contact them back after they charged me another set of boxes and they said they couldn’t do anything but give me a credit on the next set. Think if the food administration would look into what gets delivered they will find repeated unsafe food conditions. Add me… they need to be held accountable for charging for food that is not safe to consume.

    I tried Hello Fresh for the first time a week ago and I should have seen the red flag when I placed my order, but I ignored it. Shame on me. I was shown before placing my order what my charge total would be and when I got the statement on my bank, it showed that total plus another total that was not shown to me before I agreed to the order. Funny thing is I copied the chat transcript where another agent assured me that the amount would be as it stated. Also, when I received my order, the meat was completely thawed out. We had to throw that out out of fear. Then, 5 days before another box was to be delivered, I got charged 145.91 for a box that will be delivered in 5 days. I did not get to pick my order out and the bill came a lot faster than expected. I tried to contact customer service, bad idea there, and I was told that I had to cancel 5 days prior, to cancel your account, which you better beat them to the draw on that before they charge you. Because of the other class action I read about on a possibility of E.Coli from the health department, I am fearful of the next shipment coming in that I unfortunately already paid for 5 days in advance. New customers beware.
