GNC hCG Activator & HCG Platinum X-30 Class Action Lawsuit

By Sarah Pierce

hCG ActivatorA class action lawsuit has been filed against GNC Corporation and the manufacturers of the hCG Diet supplements hCG Activator and HCG Platinum X-30 for illegally and deceptively promoting, marketing, distributing and selling a product the FDA has dubbed “an economic fraud.”

The GNC class action lawsuit takes aim at the over-the-counter, homeopathic products hCG Activator, manufactured by iSatori Technologies, and HCG Platinum X-30, manufactured by HCG Platinum, which are purported to contain human chorionic gonadotropin (hCG) — a hormone produced by pregnant women that has been approved by the FDA to treat infertility. Recently, however, some doctors have prescribed a combination of hCG injections and an ultra low-calorie diet to patients to aid in weight loss, despite having no credible scientific evidence that hCG is effective for such purposes. The new trend has been called the “hCG Diet.”

Since the hCG Diet has taken off, numerous OTC products have appeared in the marketplace in an effort to capitalize on this latest fad diet, including hCG Activator and HCG Platinum X-30.

“However, just as there is no scientific evidence that hCG injections are effective in promoting weight loss, the same is true with respect to these over-the-counter and purported homeopathic products, which contain no more than trace amounts of hCG, if any,” the GNC hCG class action lawsuit sates. Because of this, the FDA has called these products “an economic fraud.”

“Defendants have reaped substantial profits that they otherwise would not have obtained and have caused Plaintiff and Class Members to expend money on products that they would not have purchased had they known the truth,” the class action lawsuit states.

The GNC hCG class action lawsuit is brought on behalf of all U.S. residents who purchased hCG Activator or HCG Platinum X-30 for personal, family or household use during the class period. It is seeking damages in the amount of monies Class Member paid for hCG Activator and HCG Platinum X-30 plus additional damages and monetary relief for Violation of State Consumer Protection Laws, Breach of Express Warranty, and Unjust Enrichment.

I have been trying to find this product for weeks. it worked EXTREMELY well for me and I am looking to use it again to boost weight loss. How in the hell did they discontinue this product? this was an AWESOME product that did EXACTLY what it claimed to do and honestly it should have cost a lot more than $69. As a happy and satisfied consumer of this product I am very saddened and bothered by the fact that I can no longer purchase this trusted product…HOW CAN I GET THESE DROPS?????????

    1. Dawn Saucedo says:

I agree! Its a shame they changed the name!

  2. Deb S says:

I am a female living in Canada, and I took the drops for the first 2 weeks….and started itching my skin….and started bleeding under my skin….2 days later I was driving and felt dizzy and pulled over. I literally went blind in y right eye. I immediately drove to emergency and the specialist said I had suffered a blood clot behind my eye. After tons of tests with looking for the reason I might have had the clot (Nothing came up). urge you to use this with extreme care and under a Dr. supervision, and by the way my eyesight has never returned in my right eye. I thank god for the vision I still have in my left eye.

This is just plain stupidity someone always has to ruin it for the rest of the public. I will say nothing but amazing things about this product. I actually cried when I went into gnc to buy my next bottle because it is the only thing that has ever worked for me. I just had my son 5 months ago and have lost 50 pounds. Go after the real frauds like hydroxycut or any of those fake pills that just make your heart race and do nothing for you.

same here! this was an awesome product!!!!! I’m astonished of the claims!

  4. Big D says:

Has anyone got any news on this lately?

This is just another case of “ambulance chasing”. Some lawyers watch the FDA actions (which are very bureaucratic in nature) just looking for class action lawsuits to start. Then, if they throw it out there, there are always people who will bite. In this case, those who couldn’t lose the weight, or would be disciplined enough to follow the plan correctly. This diet is, after all, quite difficult in many ways. Additionally, we all gain our weight back if we don’t change what we have done in the past! I took the HCG shots and did the diet! I lost a lot of weight. But then, I gained it back because I went back to my old ways. MY FAULT… not HCG diet’s fault! Now the drops are the same too. People are losing weight and are happy. They need to step up and stop these crazy lawsuits!!!

Does anyone know the status of this case and payout amount?

  7. Anonymous says:

i lost 25 lbs with the pills and gained it all back :( now i and trying drops from another company and getting NO results ‘cept frustration

My sister inlaw, mother inlaw, two friends, and I have all taken this and all lost over 30 pounds apiece. we took the drops followed the diet and lost the weight and maintained it for well over a year so far. I have not been able to keep the weight off on any diet in the past until now. I dont even use the drops anymore. FDA must not be getting a big enough kick back on this one. Maybe the GOV should make sure it doesent work before takeing it away.

I hear nothing but glowing testimonies about this product. Wouldn’t it be nice if there was something that really did help people with abnormal weight issues? The medical field has not been able to offer solutions for obese people except ~ bariatric surgery?? Maybe it is suspect because it has not been around very long to document side affects. I would spend a little money to give this one a try.

I do not know who it did not work for but I think if the users had followed the diet no cheating they would have lost weight too. I lost 16 pounds the first week skin glowing, energy for ten people and I did uses a dandelion root tea as a diuretic.
