Giorgio Armani TCPA text messages class action overview:

A man whose number is on the National Do Not Call Registry is suing Giorgio Armani for sending him repeated, unwanted text messages, a new class action lawsuit states.

Plaintiff Derek Hasty filed the class action complaint against Giorgio Armani Corporation May 31 in a Florida federal court, alleging violations of the Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA). 

To promote its goods and services, Armani engages in unsolicited text messaging, including to people who have registered their telephone numbers on the National Do Not Call Registry, Hasty alleges.

Hasty says the repeat sales text messages, of which he put screenshots in his complaint, have caused him and at least 50 other potential Class members annoyance, nuisance, and invasion of privacy.

Armani used robo-dialer, lawsuit alleges

He says Armani continues to send sales texts to his cell number. 

Armani is also breaking the law by failing to provide opt-out instructions in the marketing. On top of this, he believes that Armani is using a computer software system that automatically selects and dials potential customers’ telephone numbers, which is a violation of the TCPA.

He is suing on behalf of anyone who has had more than one text message from the company within any 12 month period in the past four years, whose number is on the National Do Not Call Registry and who hadn’t recently dealt with the company or registered interest in its products or services. 

He’s seeking certification of the class action lawsuit, damages, an injunction, and a jury trial.

In February, Giorgio Armani Corporation was accused of unlawfully collecting the biometric data of consumers using its website’s virtual “Try-it-On” feature, a class action lawsuit alleges.
