  • Three classes of General Motors (GM) vehicle owners asked a California judge to throw out GM’s request to overturn a $100 million jury verdict.
  • The classes’ filing told Judge Edward Chen of U.S. District Court in the Northern District of California that it believes expert testimony is not needed for a class action case to succeed.
  • It also states that recent rulings throwing out defect claims in BMW and Mazda vehicles are not the same and do not apply.
  • The filing claims GM’s own witnesses testified the engine defect would occur, leading to the vehicles’ engines consuming an excessive amount of oil.
  • GM attempted to block the verdict, which would have awarded $2,700 each to class members who owned certain versions of GMC Sierra, Yukon and Yukon XL and Chevrolet Avalanche, Silverado, Suburban and Tahoe.

General Motors (GM) has been ordered to pay more than $100 million to classes of vehicle owners who argue the company sold vehicles with defective engines. 

A federal jury in California delivered the verdict against GM after less than one day of deliberation. It will benefit three classes of around 38,000 GM vehicle owners from California, North Carolina and Idaho, Law360 reports. 

Vehicle owners, who will receive $2,700 each, had accused GM of selling vehicles — including certain of its GMC Sierra, Yukon, Yukon XL and Chevrolet Avalanche, Silverado, Suburban and Tahoe — with a hidden engine defect that caused them to consume an excessive amount of oil. 

Jurors determined that GM breached its implied warranty and implied warranty of merchantability with the vehicle owners and violated Idaho’s consumer protection act, Law360 reports. 

Vehicle owners claim GM engine defect hidden from the public 

The vehicle owners claimed GM hid a defect in engines the company introduced in 2007 while the automaker reportedly argued that it discovered and fixed the problem. 

The vehicles at the center of the GM engine defect class action lawsuit include trucks and SUVS sold by the company between 2011 and 2014 that contained a Generation IV Vortec 5300 LC9 engine, Law360 reports. 

An engineer for GM reportedly testified during the trial that the automaker developed a cleaning process as a potential remedy to the defect that turned out to not be effective but was less expensive than a different potential fix. 

A separate class action lawsuit filed against GM escaped dismissal last month after a federal judge in Georgia mostly denied the automakers motion to dismiss claims it made defective engines.

    I have a 2013 GMC terrain with the 2.4 L and it has had nothing but oil consumption /High fuel pressure/ catalytic converter / Problems / it’s presently at a GM Dealership in Morris IL and dealership is saying they don’t know what’s wrong with it . I’m really at my breaking point and looking to contact General Motors over the matter

    have 2012 GMC pickup with 51,000 miles on it. Had the lifters fixed 3 times. Now need new camshaft/ lifters (delete kit).

    I bought a 2012 Chevy Avalanche LTZ with 130000 miles on it, this truck has been a constant headache. Very nice truck, unbelievably comfortable to travel in, very good on gas for a large truck, IF it is running properly. Unfortunately, the truck running properly is an extremely rare phenomenon. It it one problem, I would say after another but, the problems even overlap. Before you van het one problem fully fixed and released, another problem will occur. O2 sensors constantly going bad, water pump, power steering pump, fuel pump, evap problems with, I must mention, an irreplaceable vent valve on top of the tank, when it goes out it takes very frustratingly a very long time to put gas in the tank I have to pull the pump knozle handle less than half way or it will click off lime the tank is full I have surgical repaired hand and wrist which makes that a very painful process. Yo fix the vent valve (already changed air filter, purge valve, evap canister and evap lines) what normally, as in, any other vehicle, a vent valve 8s about $20-$45, however, this truck you have to replace the entire gas tank at close to $700 just for the part, battery draining issue, bad coils, fuel 8njectors, top of dash cracked and partially caved in via no impact and nothing being placed, in any way, on the dash which I have kept clean and treated apparently the dash isn’t strong enough to handle the wind of a rolled down windowml. I also had to replace lifters twice, and the piston rings once, then as if thatvwerent bad enough, due to a plastic framed air intake manifold gasket, the plastic frame breaks and sends anti-freeze, GM specific Dextron anti-freeze which is very corrosive, is sent through the intake manifold and through the throttle body and makes its way into the oil, and somehow sent anti-freeze contaminated oil through the intake manifold and throttle body also, which caused a lack of anti-freeze in the cooling system and an overheated engine, an overheated engine, that is, with anti-freeze in the oil caused the crank shaft bearings to go out and a need for another engine, which parts and labor cost me over $7000 and between that and other repairs, several months with no transportation. I live in a very rural area of South Carolina, the clisest, any kind of store almost 10 miles from my house, any shopping, grocery store ECT, is at least 15 miles away, no access to delivery, cab or uber service out hete. I just got that paid off, by skimping on my necessities, and now my transmission is bad due to GM known faulty transmission components, it is the 6 speed tranny, here I am again without transportation and needing a parts and labor cost of around $5,000. I am a disabled veteran living on fixed income, I had to sacrifice anything but rice and peanut butter for several months for an engine, this is the first month I’ve gone grocery shopping, since. I have been detattched from my VA medical team and now have to go through the process of reregestering with another healthcare team, due to having no way to my doctor appointments including missing my, much needed, hernia surgery. My truck payments are $451 per month and $140 per month insurance, still owe $13,000 on it, I bought the truck in July of 2021, and it has been inoperable for more than half the time I’ve had it. I’m stuck with a money pit with a barely getting by pay and stuck at my house, isolated and disassociated with no way to go. Although the $2,700 from the lawsuit (I bought the truck in NC which included me in the lawsuit, I got the notice card) would help a great deal, if it ever goes through and sent out, it is but a small drop in the barrel of what I have spent and what it has cost me, including but not limited to my mental stability from isolation and a increasingly worsening hernia condition and worsening conditions of my combat related deemed permanent and total disability with no means of getting to medical care I need. Not much hope left in this hosehold

      This is absolutely disheartening and should BE ILLEGAL!! Theses folks know their cars are poorly made and think 2700 will fix the issue. I’m pissed at the fact my car is broken down through no fault of my own and this Hass been an issue before I got this particular vehicle. SO IN ESSENCE the GM has had years to fix the problem and REFUSES TO DO SO

    I have a 2010 colorado cylinder 4.2 ltr that the dealership is telling me needs a new motor at 110k and gm is making me pay for a”recent” diagnostic before they will consider helping me. And if they do help me id be looking at 10% due to age and mileage. The problem is a known issue with the valves being weak, making it seem like a blown engine with even exhaust in the radiatior and everything. I’m paying 400 a month for a truck that i can’t even drive someone please help

    I have a 2021 Chevy Malibu with 40,000 miles on it. The engine just turned off while driving on the freeway one night. Now Chevy dealership Fairway Chevrolet in Las Vegas Nevada is telling my that my engine is bad and that the warranty wont cover because it must be my lack of maintenance that caused the engine to give out. Even if I did NOOOO maintenance (which is not the case) it should not give out yet. It just seems wrong to me.

    My 2007 blew up lack of oil being used on the DoD had to put another motor in 7.000dollars had to borrow the money just about to pay it off very poor the truck was never driven hard and by my wife we love or 2007 Chevy AlvancheLS5.3 and the oil was changed at the time of the manual but used2 to 3 quarts every oil change and now I know why thank you so very much for getting their butt help me please

    2018 GMC Yukon Denali
    Always performed any and all preventative maintenance and repairs.
    The vehicle has been nothing but a money pit.
    Broken motor mounts, valve sleeve collapses $5k, 120,000 mile blown engine costing $13k, 130,000 mile blown torque converter $4k, and no assistance from GM

      2013 Denali blown engine for me. Just a hunk of metal with $15K damage. No help from GM.

    I have a Chevy Silverado 2013 1500 LTZ 5.3L vortex. I live in Oklahoma and had been made aware of the issue. My truck is now in the shop and will cost more than 3500 to fix the problem. Can i get some help. I’ve spent a lot on that truck trying to maintain only to find out the issue was with manufacturing

    I have a 2018 Chev Silverado with rattling lifters. My local dealer has done all my service work since they sold it to me. I have it serviced religiously as recommended. I have been told the repair cost is $3500.00 to $4000.00. I’m 72 years old drive at stated speeds and do not abuse my truck.
