GM data class action overview: 

  • Who: Plaintiff Romeo Chicco filed a class action lawsuit against General Motors (GM), OnStar and LexisNexis Risk Solutions.
  • Why: Chicco claims GM and OnStar collected his driving data without his permission and shared it with LexisNexis Risk Solutions.
  • Where: The GM class action was filed in federal court in Florida. 

A class action lawsuit claims that General Motors (GM) and OnStar collected driver information without consent and shared it with LexisNexis Risk Solutions, impacting drivers’ auto insurance premiums.

Plaintiff Romeo Chicco purchased a 2021 Cadillac XT6 on Nov. 16, 2021, and downloaded the MyCadillac app but never signed up for OnStar. Chicco’s auto insurance company stopped offering coverage in southern Florida in December 2023, and when he applied for new insurance, he was surprised to find himself denied.

Chicco was informed by Liberty Mutual that the denial was due to a driver report from LexisNexis Risk Solutions that showed 258 driving events, which he later determined were recorded by OnStar.

OnStar records the GM driving info without authorization and sells it to LexisNexis, Chicco’s lawsuit claims.

“The data presented on the Lexis Consumer report is so decontextualized that it can hardly be called accurate,” the GM class action says. “Nevertheless, insurance companies rely upon these consumer reports to determine pricing or flatly reject a potential customer, as has happened here.”

Other owners of GM vehicles have reported insurance rate hikes because of GM data

The New York Times highlighted similar issues with LexisNexis data leading to increased insurance rates for GM customers.

“Automakers, including G.M., Honda, Kia and Hyundai have started offering optional features in their connected-car apps that rate people’s driving,” the New York Times wrote. “Some drivers may not realize that, if they turn on these features, the car companies then give information about how they drive to data brokers like LexisNexis… Especially troubling is that some drivers with vehicles made by G.M. say they were tracked even when they did not turn on the feature — called OnStar Smart Driver — and that their insurance rates went up as a result.”

Class counsel is asking for actual, statutory and punitive damages along with attorneys’ fees and costs.

GM recalled 570,434 trucks in the United States earlier this year due to a tailgate issue that can increase the risk of a crash.

    Pulled my report, GM collected and sold 192 pages worth of driving data that is now associated with my name by LexisNexis. I didn’t consent to this activity and also find it disturbing because neither GM nor LexisNexis would have any way of knowing who was actually driving the vehicle – yet the driving data is automatically associated with the registered owner. This means people are being penalized for activities they may not have done. Happy to share my report and more details with anyone pursuing action.

    I have a 17 Explorer and there is no OnStar but.. when I took it in for a recall the service manager was aware I was thinking of selling it and without my knowledge informed me my driving habits were excellent and someone will get a great car. Then he explained what all he could see!! I was shocked!

    I have a ’16 ACADIA this explains why my rate has gone up 4x the amount I had first paid 6 months ago. Lexus nexus has no business monitoring my driving. The information was not permitted for collection and sharing. It’s bad enough GM can’t even install airbags correctly muchless install FUNCTIONING equipment

    I have OnStar and my premiums have increased by $60. If I ask my insurance company if they use my driving data to decide what my insurance rates will be, will they have to tell me?

    I have a 2022 Silverado, I am have not signed up for On-Star and receive an email each month. they know specifics about my vehicle. I receive offers from the local dealership in regards to upcoming services my vehicle may need. Obviously this information is going to the dealers.

    I bought a ner 2022 corvette and after having Liberty Mutual insurance for 5 years and having accident forgiveness, They raised the insurance on that car by $1500. I changed carriers to Erie Insurance and was back at my original rate from Liberty mutual. I also found out my 2023 Genesis was being tracked as well and even gave me a score of 75 and two events showed fast acceleration and a quick stop. I turned off my smart auto at gm and a customer service person at Genesis did the same.. She had originally told me I was not being tracked, then I told her I found it on my account myself.

    My wife and I were going to renew our policy January 2023 with our insurance company . After 12 years with one windshield claim, the rates were astronomical. We owned a 2019 GMC Terrain SEL,2020 Cadillac Ct5 Luxury ,2021 Cadillac XT4 and a 2022 Cadillac Ct5 Sport
